California tire fee $7 ?!?!

What the heck is that?

OK, I just looked it up. Tesla should NOT be charging the California tire fee. The following sales are exempt:
"Sales of new tires that the retailer ships directly to a location outside California when the transaction is not cubject to California sales or use tax".

So if you're getting your delivery in Massachusetts, Tesla should not be charging the California tire fee. Demand your $7 back, Robert!

I'm also not happy with "registration, transfer, and titling fees" being lumped together without a breakdown. Here in NY, the fees are a mess of little things:
- $32.50 registration (this one may involve a fight at the DMV as I noted elsewhere)
- $20 county vehicle use tax
- $50 title
- $25 plates
- $10 safety inspection
- *maximum* of $75 in fees from the dealer for "assisting" with the process

If I see a number under "registration, transfer, and titling fees" where the total is too high or too low, how do I tell which part they got wrong?

Notably, you're in Massachusetts. I see $50 for plates and $75 for registration which totals to $125. Which means they haven't applied the state safety inspection fee before delivering the car. (Or maybe that's included in the "final inspection, prep, and coordination" fee?) Here in NY, the auto dealer is required to do the state safety inspection before delivery...

Sloppiness in financial affairs is something I do not tolerate, and I don't like it much in legal affairs either.

Bad work, Tesla, bad work.

Don't worry, Massachusetts gets my money in other ways. It earned the "Taxachusetts" nickname (even though we're "only" 11th on the tax burden as a % of state income).

Somebody decided to alter their ME license plate to change the Vac to Tax and the courts ruled it legal since they weren't defacing anything essential.

No incentives here and 5% sales tax plus 9.15% in Vehicle Excise Tax over 10 years, front-loaded starting with 2.4%.

TM not a 'new tire retailer' and not a 'shipper of new tires' so from two points of view: fageddaboudit. I already hashed this out with my Tesla Co-ordinator. Concept: the tires on your ModelS are 'used', as opposed to a shipment from Tire Warehouse, assuming TW might ship from Calif, where you see fresh untouched tires when you open the box at home.

Also, TM will not be charging me for any WY taxes/fees that I'm prepared to pay WY myself. They will be glad to pay these directly and ahead of time but are not insisting on doing so. Actually, their offer to pay WY sales tax, etc ahead of delivery is 'out of their pocket' since I'll be paying for the ModelS on the day of delivery. Or more accurately, 'out of my non-refundable $5k'. Which might not cover it anyway.

Lets cut them some slack, they are really going overboard to please & ease in every way possible.

Does that agreement mean if you don't have a cellular or mobile phone you cannot purchase a car? My employer requires I carry around the one they pay for but other than that don't have one and don't want one.

I have no plans to own a cell phone anytime in the next 20 years or so. I have a temporary work cell phone for about then next 2 months, and i hate having it. Pain in the ass to get reception when I actually need it for work.

Perhaps ask for a satellite phone from your boss? :) I also only have an emergency mobile phone used mainly to make outgoing calls when needed, so it stays off 99.9% of the time. I don't have Wi-Fi at home, either, so I plan to tell the delivery specialist that I can simply drive to Starbucks once every month to get updates from Tesla. lol

That's an example of "bad legal drafting". What the agreement *should* have said was, "if you have provided us with a cellular or mobile telephone number, you consent...." I would call Tesla about that. (Another point to add to Tesla's "legal punchlist"...)

The section is there because people get charged to receive cellphone calls, which is something US law should never have allowed, and is one of the main reasons I will never get a US cellphone. I'm pretty sure Tesla is actually perfectly happen to call your landline.

Bad legal drafting is endemic. Tesla's lawyers clearly suck, but then so do most lawyers. I've spent a disturbing amount of time rewriting contract drafts by supposedly good lawyers to correct them.

More obnoxious is the "anti-reverse-engineering" clause. I believe it's a no-op because prohibiting reverse engineering is illegal, an infringement on fee title ownership, and it has a "save only to the extent permitted by applicable law" clause. However, I would almost certainly X it out anyway. Another on the Tesla "legal punchlist", and I'll have to call them about it.
 
I found this thread helpful and reassuring as I finalized my paperwork. For the benefit of those that follow here is some more information that I learned from my Product Specialist. The MVPA is a preliminary estimate, there will be more paperwork to sign, at least for MD Title and Registration, as delivery gets closer. I plan to get commerative tags rather than the vanilla state tags; that will be handled by the local delivery specialists. The standard registration, transfer and titling fee for MD is $280 (MVPA line 2B) - the fee breakdown is $100 for new car title plus $180 for registration (cars > 3700lbs.). I also have to give credit to Tesla for properly calculating the sales tax without the $2,000 exemption ($4600 - $2000). One step closer to having my Model S - P#6000, est. delivery Jan/Feb 2013.
 
Tesla Personal Delivery and final inspection, prep, and coordination are included in the sales tax calculation. Robert.Boston's example is calculated similarly so I assume that's correct.

I should clarify my previous post - the $2,000 sales tax exemption is for MD EV cars. Your state's policies may differ.
 
Canada Pre-Delivery MVPA

Have my Pre-DeliveryMVPA for Canada and there is a Vehicle As-Is clause in the contract. It seems related to the Ontario Motor Vehicle Council but I have never encountered such a clause on a new vehicle. I'm assuming all Canadians received this same clause?

I called the Telsa Hotline and the gentlemen I had could not answer why such a clause would exist. He forwarded me to the Toronto store which I'm awaiting a callback from currently.

Anyway here is the clause which really makes no sense and certainly does not inspire confidence in signing an $80k+ contract. :confused:

VEHICLE SOLD "AS-IS". The motor vehicle sold under this contract is being sold "as-is" and is not represented as being in road worthy condition, mechanically sound or maintained at any guaranteed level of quality. The vehicle may not be fit for use as a means of transportation and may require substantial repairs at the purchaser's expense. It may not be possible to register the vehicle to be driven in its current condition.

Are you sure this doesn't refer to any clause in the pre-MVPA about buying a used Model S????

My only response to this clause (if it refers to a brand new Model S) is: WOW. :scared:
 
Thanks for confirming you had this as well Kevin. I finally talked to someone at the Toronto store, says this really should not be in the contract and is not in the final delivery contract. He will follow up with HQ and get them to revise the pre-delivery MVPA.
