It may also be illegal to use summon in a public place. I am sure the insurance companies have clever lawyers, especially if an accident occurs and you hit another car or damage property. I hope your cover in writing is not overridden by "operating a motor vehicle in an illegal manner". Lots of outs on that one - alcohol, drugs, car worthiness etc
In WA (at least) Road Rules apply to anywhere the Public has access, so including shopping centre car parks.
We have a further difficulty in WA (not in VIC apparently). Not only must the driver be in control (which we would argue he is), but he must have clear view of all mirrors (which he may do, but not necessarily from the mirror side).
Our authorities are fully aware of the Road Rules difficulties and are trying to get amendments pushed through to avoid an over zealous policeman taking first action.
The QLD laws are apparently the strictest in the country now. They don't define "driving" anywhere in that page, but I've seen RACQ statements that say you have to be "legally parked" to get away with having a phone in your hand. So if the Tesla is in P mode, it's going to be OK.
