Blog Elon Musk to Exit Trump’s Advisory Councils

Tesla CEO Elon Musk announced he will leave President Trump’s White House advisory councils following a decision for the U.S. to withdraw from the Paris Climate Accord.

Musk tweeted his feelings on the decision after Trump held a celebratory press conference, complete with a jazz band in the White House Rose Garden, to announce the move.

Musk will exit Trump’s economic advisory board, as well as his manufacturing jobs initiative council.

The Paris Agreement, an important part of President Barack Obama’s legacy, provides a framework for countries to adopt clean energy in an attempt to prevent the planet from warming more than 1.5 degrees Celsius above preindustrial levels.

We have this thing in the US called the Constitution. Neither President Obama nor President Trump has the Constitutional authority to partipate in or opt out of the Paris accord, that requires a 2/3 senate majority vote, something that Obama conveniently and illegally ignored with the help of the press, and that apparently still escapes the attention of the mainstream media since this elephant in the room is hardly ever addressed. Whatever you think of the Paris accord, it’s ratification requires Senate approval which it would never get, either when Obama signed it or now.

Unfortunately, the Paris Accord is not a treaty so Trump can pull out of it (and Obama did not need the Senate because it is not a treaty), but constitutionally Trump can't pull out of the underlying UNFCC framework adopted as a treaty in 1992.

"The deal (Paris Accord) is considered an executive agreement, and therefore not a traditional treaty requiring ratification by two-thirds of the Senate, because it doesn't bind the country to certain outcomes such as specific reductions in greenhouse gas emissions."

Calling it an "executive agreement" is nothing more than a transparent parliamentary trick to bypass the constitutional requirement for senate ratification because it lacks the popular support to be implemented democratically.

The issue I have with the Paris accord has nothing to do with global warming. It has everything to do with whether the US is governed by the constitution and divided powers.

I agree. The President cannot enter into legally binding treaties with other nations.

The President does have the Constitutional authority to enter into executive agreements with other nations.

The Paris Agreement, being an agreement, does not require senate approval.

Thank you for clarifying that so that some people can have a fuller understanding of reality...

It appears that the council has been disbanded.

Nobody wants to be the last rat on a sinking ship. Elon has been focused on his business and the future. Good call back then Elon!

Here are some words of wisdom from the Constitution...

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.
