The irony is that he thought he was enhancing his reputation, instead he trashed it. Been there. Done that. In many situations, it is much better to just walk away from accusations, and let the reputation of the accuser, and your historical reputation, and your actions, all speak for you.
I’m guessing that, as a guy who is accustomed to being right, he felt like he was going to be easily validated. That’s one of the dangers of that style of confidence.

He just let his emotions get the better of him. This happened during the model 3 production ramp up hell, iirc. He was putting in a lot of effort to try and help, and he gets trashed for it. Some combination of a hurt ego, pride, and being really tired set the whole chain of events in motion. It didn’t help that they hired a crook as a PI, and then Elon was naive enough to think the press would act honorably. As per the comment above, no one in this sorry mess comes out looking good.

Musk broke the law with anti-union tweet, judge rules

Musk's tweet broke the law. Tesla and Musk violated federal labour laws.

Worker reinstated with back-pay.

Tweet was accurate:
"Nothing stopping Tesla team at our car plant from voting union," Musk wrote. "Could do so tmrw if they wanted. But why pay union dues & give up stock options for nothing?"

Name any Union plant where the employees get stock options as part of their union negotiated contract. It was not a threat, it was reality.

The judge specifically said that his tweet was a violation of federal labour law. Best to just avoid tweeting about such things.

Musk seems incredibly naive, like he has no idea how to run a large business. It's pretty basic not to tweet about that kind of thing for precisely this reason. He's become the textbook example of why senior staff at large companies need to keep their mouths shut.

And I disagree with them.
Funny thing is, my reading of the judgment makes it look like Musk has to personally tell the employees what he is not allowed to tell the employees. Maybe he'll also tell them the recent UAW goings on...

Labor law is insanely biased against employers. Judges are not infallible and routinely get overturned on appeal. Even if this judgement stands it has essentially zero consequence to Elon or Tesla.

Complete nonsense... a liberal California judge says it is fine if employees lie in response to questions regarding the union.

The judge ruled that Ortiz's firing was illegal. "An employer may not terminate an employee for lying in response to questions regarding" union organizing, the judge wrote. The judge also noted that Tesla did not seem to have standing rules against browsing employees' profiles on Workday or screenshotting them, suggesting that Moran was singled out based on his pro-union efforts. The judge ordered that Ortiz be re-instated with back pay and that the disciplinary action against Moran be scrubbed from his record.

Tesla fired a union organizer. The guy LOST HIS JOB for engaging in a legally protected activity. You think a different judge would have changed that result?

Was it the act or the coverup (lying)?
Nixon, Stewart

Further, just because something is legal does not mean to are allowed to do it on company time, on company property, or with company resources. Apparently, the computer use policy needed updating.

The guy Musk hired to investigate his victim has turned out to be a convicted felon and known scammer. It's not clear if that's why Musk hired him or if Musk himself fell victim to another of his scams.

He contacted Musk et al to provide them information (e-mail communication is in court documents). Appears to be that Elon was scammed.

(not that I trust Buzzfeed based on their past behavior regarding Elon)

Agreed. A judge making a ruling based on what the law says is not making a liberal or conservative decision, they are doing their job properly and interpreting the law as it is written and commonly handled.

With the newer gigafactory becoming its own full car manufacturing plant, Elon could one day just move production from the US to one of the other locations. (If they do unionize and become a problem.). Leave the existing US manufacturing for parts only. Let the final assembly be in Canada or Mexico for the US.

Unions were needed years ago. But unfortunately they have gone overboard with their demands.

And certainly today, with a low 3.5% unemployment rate, I doubt it would be hard for a minimally competent line worker to find good wages somewhere if Tesla wasn’t paying enough or conditions weren’t good.
