Let’s play is it totaled or not?

I independently picked this shop (based on location, that they are Tesla certified, and the estimated repair time), later when switching to State Farm (my insurance) due to the underinsured issue of the other party, this shop turned out to be a "preferred shop" with State Farm... so I guess when it comes to shop I'm probably in the best case.
Those things lining up for you will make it easier (I’m not saying easy, but easier) for you.

There is nothing easy about getting into a crash and needing your car fixed.

Updated estimate: $33,554 (after my $500 deductible).... they estimate 42 days for the repair once they get parts... Not sure how they're estimating this, but they suggest end of June will be when they'll be done... yet Tesla hasn't even provided a shipping estimate on the extra parts they're ordering.

What's the over/under on if it's totaled now... the collision center said they don't think it will be totaled... 2022 Red/White Performance Y with 9,400 miles

They're already paid $1,500 out for a rental as well, so we're at $35,000 right now... it sounds like repairs + scrap value is how they determine total loss or not... what do you think the vehicle is worth as scrap? From my understanding the battery is completely fine and probably the motors as well... would that be $10k or so? That could get *very* close to what my pre-accident value was I think... I kind of can't believe this, but Tesla is estimating trade value with no accidents at $38,700 to $41,200!!! (I certainly don't want to use that value as my total loss amount... New is like $58k and used would be around $52k for my mileage.. )

Current update is...

On May 16th I was updated by Crash Champions Monroe in Spokane, WA that the Tesla parts for the frame rail still are backordered and still show no ETA... so that's fantastic

My second month of a rental was just paid by my insurance through the uninsured motorist property damage (so still not dipping into my rental coverage and still not requiring a co-pay from me). So shitbox has been avoid now until June 10th when I'll likely have to renew the Tesla Hertz rental for a 3rd time. (Maybe I'll go Polestar next time?)

This means insurance has paid out $2,767.04 for rental coverage already! They've paid $1,340.72 in towing fees so far... and the estimate for repair still sits at $29,367.42 (not counting the $4,300 estimate for the reapplication of paint protection film which I'll push really hard on).

That means total so far paid out is $4,107.76 with a total estimate of costs being $37,775.18 (when factoring in current rental, tow, and repair costs).

I spoke to State Farm a couple weeks ago and they have no idea what the amount would be to total it out... they said they let the repair shop figure that out. I requested that information from the repair shop and they just texted back "based on number we are not at a total loss" so they either don't understand the question (What cost for repairs plus scrap value would push the car into total loss territory) or they don't know either... If the scrap value is $15,000 (again, motors and battery is fine, interior is fine, rear is fine) then the total would be almost $53k, I would think that would be a total loss...

BUT, State Farm also said they don't factor in towing fees or car rental fees *at all* in the total loss calculation... so I guess they could pay like $15,000 in rental fees and towing and not have that push the needle at all towards total loss... which seems odd.

Update: Got notice the other day that my vehicle will be ready this Friday, I was surprised by that!

So far insurance has covered Tesla rentals... I reached out to my detail shop (ALSET Auto of Portland) for how long I need to wait after new paint before I can get the matte PPF applied again... I suspect it will be ~20 to 30 days so I'm probably going to eat the cost of a rental for a month... which means about ~$1500 for a Model 3 from Avis (Hertz was all rented up for this next month!)

Still haven't heard anything official from my insurance on the cost of PPF being applied again, I wonder if they're just waiting till I submit paperwork to be reimbursed for it...

Collision shop submitted their final estimate/quote to insurance, $36,180.54. That includes the $4,300 to replace the film. The collision center suggested I have them write it up in their quote and then they will submit it to insurance and pay my detail shop directly... they thought that would be a higher chance of being approved vs me trying to get reimbursed. We'll see if I have a fight over that.

I've hired a diminished value guy (recommended via Facebook Pacific Northwest Tesla Owners group) for $750. He estimates between $10k and $14k in diminished value.

So far insurance has paid out $2,767.04 in rental coverage and I have yet to submit this last month which will be another $1,600. State Farm did call me out of the blue last week saying they had over paid me $700 and some for rental coverage and I needed to pay that back. They kept talking about how my rental coverage on my policy only allows for $1000. I reminded them I was not at fault and that my rental policy should not come into effect, it should be billed via my under insured/uninsured coverage. She got very confused and asked if the other at fault party had any coverage or not and I said $10k, state minimums, take the rental costs out of that $10k before anything on my policy kicks in. She seemed surprised and said that it had been processed as an uninsured accident (I think WA state only allows coding it as uninsured or something? I recall someone at the start mentioning they were the same thing on State Farm's side but the computer system would only show one or the other sometimes depending on which state). She said it had been submitted to the personal injury team and kept asking if there were injuries (no) and then said she would escalate it to a specialist. I'm sick of idiot low level phone people handling stuff before the specialist. If there is a special team that will dig into claims, run it by them first before you call the customer with incomplete information. We'll see if I have to argue that. My diminished value guy said I have the right in WA state to have all my gas cost covered if I own an EV but have to rent a gas car, so I'll at least try to estimate that and claw that amount back, but they also claim I have the right to an equivalent vehicle, and a crap box econo car is not equivalent to a $50k to $70k EV. So we'll see if I have to turn to him for help on that...

I'm having the vehicle transported down via enclosed carrier from Spokane WA to my detail guy in Portland OR and my collision center is trying to get insurance to cover that cost too. It's $875 that I might just pay out of pocket if I have to fight with that. It saves me two flights and over six hours of driving... that might be worth it not to fight. It'll get there without rock chips or anything. THOUGH, that is cheaper than the tow from Spokane to my house, which insurance probably WOULD pay for since WA state law says insurance must transport the vehicle to the shop and back if it's an "unreasonable distance to the repair facility," I consider 150 miles unreasonable....

I will say, I'm a little curious if I could have (or still can?) have Progressive (the other at fault party) pay out the $10k to me and THEN I file an uninsured claim with State Farm? I didn't think of that initially, but that could have covered "out of pocket" stuff that wasn't going to be covered, like a rental car for three months... if that would have been possible, then I'm going to fight like hell that State Farm apply the $10k to stuff like that first before paying themselves back and denying me coverage... My diminished value guy suggested I demand that if they give me crap about the transport fee to the detail shop or the paint protection film... so maybe that's a thing?

(I'm banking a little on justifying the Portland detailer (I love you @ALSETAuto ) because my film has a very drastic color change, satin/matte, and I would worry that a different brand of film would not match perfectly. There is no where local that works with GSWF films and I'm not sure if there was a GSWF installer in Spokane, so I feel like there is some justification to returning the vehicle to the same shop, who also specializes in Tesla vehicles, for the repair work on the film.)

If anyone is keeping track, that will be a grand total of $48,947.58 they pay (assuming they pay the $10k diminished value, but I'm hoping it's closer to $12k to $13k) and $50,288 when adding in tow costs. Someone is going to have to file bankruptcy... she'll be on the hook for at least $40k after her insurance pays out the $10k minimum if State Farm sues her.

Carry sufficient coverage people. Maybe not $500k for everyone, but $50k to $100k in today's world absolutely makes sense.

Did you already set up the DV claim with the other side's insurance? You can't get DV from your own insurance. I am curious if the other side's insurance will prioritize your DV claim before the subrogation claim since there is only $10K. Your insurance will send out the subrogation claim after your car has been repaired and payment finalized. If you want first dip, you probably should act quick.

You can get DV from your own company in (I think) two states. MA and GA (two states I haven’t worked with). I wouldn’t be surprised to see State Farm punt completely on a DV claim in this case and tell the OP he can sue the at fault party for the claim.

When I asked my own insurance about the DV after I got rear ended. There is a line item in the policy prevents me from claiming DV against them and I should go after the other party. I submitted DV claim on my own against the other insurance firm and negotiated a payout. My insurance also got the collision repair subrogation claim paid and my deductible back. Mine did not have the coverage limit though. I am very curious on what happens to OP next. Who gets the first Dip of that $10K.

This is very interesting, I hired someone to prepare a DV claim for me, on recommendation from someone else in my state that was rear ended by someone that was uninsured. They were able to get a DV claim paid out... and the guy knows that I'm having to run it through my underinsured motorist property damage coverage because the other party doesn't have the coverage... in fact on the FAQ on their web page they state; "That depends on the circumstances. In most cases, you collect from the at fault party insurance company; or else through your own underinsured motorist coverage if applicable."

So.... I'm hoping I'll be able to go after a claim on my policy which has the coverage, otherwise I'm going to be rather pissed off and certainly fight for everything damn little thing to be covered and point to the $10k that they're getting from Progressive as the pot of money that should be used first for stuff like rental and transport costs, etc.

Quick update to this, I'll speak more about ultimate repair quality and stuff like that later when I have more time, but I finally reached the end of this and was paid out a diminished value amount. The person I hired researched and calculated an $11,144 diminished value and my insurance offered $9,000 today without further approvals or research on their end. Since I just want this done I jumped at that offer, it was close enough that I thought money in pocket was better than waiting for them to investigate or something.
