Wiki Model S Delivery Update

Just sent a message to my Tesla rep about our order for our Tesla S Long Range Plus that has been on order since early January.

He said: "Timeframe for all Model S vehicles are March at the moment. Since you ordered previously, you will have delivery priority. Additionally, pricing for the Model S did increase. Price for the Long Range for the Model S increased to $80k (previous started at $70k) with the refreshed look/interior changes. Your Model S will be sitting at $92k with the self-driving. Would that work with you?"

Um. I thought the order agreement locks in the price?

I ordered December 5 and have never heard from a person at Tesla. AFAIK I haven't been assigned a sales rep. Not even sure if my delivery will be Tulsa (4hr rnd trip) or Kansas City (4hr each way). I've bought more than 70 cars and this is by far the most losey-goosey.

Did you read it?
Yes.

Agreement to Purchase. You agree to purchase the vehicle (the “Vehicle”) described in your Vehicle Configuraon from Tesla, Inc. or its affiliate (“we,” “us” or “our”), pursuant to the terms and condions of this Agreement. Your Vehicle is priced and configured based on features and opons available at the me of order and you can confirm availability with a Tesla representave. Opons, features or hardware released or changed aer you place your order may not be included in or available for your Vehicle. If you are purchasing a used Vehicle, it may exhibit signs of normal wear and tear in line with its respecve age and mileage.
Purchase Price, Taxes and Official Fees. The purchase price of the Vehicle is indicated in your Vehicle Configuraon. This purchase price does not include taxes and official or government fees, which could amount to up to 10% or more of the Vehicle purchase price. Because these taxes and fees are constantly changing and will depend on many factors, such as where you register the Vehicle, they will be calculated closer to the me of delivery and indicated on your Final Price Sheet. You are responsible for paying these addional taxes and fees. If Tesla is registering your Vehicle, this will be due when you pay the purchase price. If you are registering your Vehicle in a self-registraon state, the sales tax and state-applicable registraon fees may be due at me of registraon. If you present a check for any payment, we may process the payment as a normal check transacon, or we may use informaon from your check to make a one-me electronic fund transfer from your account, in which case your bank account will reflect this transacon as an Electronic Fund Transfer. If you are purchasing a used Vehicle, your Order Deposit will be applied to your Purchase Price.
Order Process; Cancellaon; Changes. Aer you submit your completed order, we will begin the process of preparing and coordinang your Vehicle delivery. At this point, you agree that any paid Order Fee, Order Deposit and Transportaon fee have been earned. If you cancel your order or breach this Agreement and we cancel your order, you agree that we may retain as liquidated damages the Order Fee, Order Deposit and Transportaon Fee, to the extent not otherwise prohibited by law. You acknowledge that the Order Fee, Order Deposit and Transportaon Fee are a fair and reasonable esmate of the actual damages we have incurred or may incur in transporng, remarkeng, and reselling the Vehicle, costs which are otherwise impraccable or extremely difficult to determine. If you make changes to your order, you may be subject to potenal price increases for any pricing adjustments made since your original Order Date. Any changes made by you to your Vehicle Configuraon, including changes to the delivery locaon or esmated delivery date, will be reflected in a subsequent Vehicle Configuraon that will form part of this Agreement. Absolutely nothing in there says A) they MUST deliver you a vehicle as configured or B) if unavailable, your price carries over to different configuration. In fact it says the opposite.

If Tesla breaches this agreement, all they owe you is your $100.

There is absolutely zero holding them to your price for a new configuration. Man, people really don’t get how contracts work.

Even in a blatant breach, your only damages are your $100. They refund that, any issue is fully cured.

I’m not saying this as someone who doesn’t want this to happen; I have an S LR+ order in from early January. All anecdotal evidence says my options will be “pay $11k more or cancel.” I’m pissed about this, but I’m not being unrealistic and saying they can’t do it. They can, and it looks like they will.

Just because they’ve honored previous order prices before doesn’t mean they will or have to again. If they were to do it, it would be purely out of customer goodwill, not a a legal requirement.

All signs right now are pointing to the new price being the new price, period.

Order placed! I have a black 75D, which I love but due to the lack of exterior updates, I decided to switch it up and go with red.. Otherwise I'd get the "Oh you got a new car? I didnt even notice"

Total price adds up fast with extra for color/Wheels/Interior choices... March is going to come quick! I'm scared to check the value of my 2018 S

Just crossing my fingers and hoping Tesla does the right thing and honor previous placed orders. That would show some compassion to their loyal customers.

Here is what I just received...I guess better than nothing. Especially since I was going to pay for Chrome Delete and a spoiler anyway.

Existing orders may upgrade their order to the new configuration and new pricing. If the order is upgraded by February 28th then it would be eligible for a $2000 decrease in pricing.

I just went through the online upgrade just short of confirming. No sign of a $2k decrease. Any idea how I get that?

How did you even get the online upgrade process?

My order is still sitting there unchanged, but my financing info is gone and my purchase agreement is no longer viewable.

The lack of info/transparency with this is really disconcerting.

I for one find it disconcerting that Telsa wouldn't honor our orders at the price we agreed to pay. As soon as I placed my order (1/18), I was hounded to put in financing information, so I applied for a loan through them. So they did a hard pull on my credit, took my $100 for a promise of a vehicle that they knew they wouldn't have available to sell? Then they ask for more money? This doesn't seem like a fair and honest business practice to me.

It isn't, but I guess the answer is "That's how Tesla does business, take it or leave it." Not great IMHO.

Still no idea what happens to my financing. Does anyone know if we need to re-apply??? Or do they just re-work the numbers? Will be even more annoyed if my rate goes up because of all this.

Based on your post history you placed an order knowing (hoping even) that they quite likely wouldn't have a car to deliver you as configured, and betting on the false hope that they would honor the existing price regardless of the delta, so I find your claimed surprise and frustration here a little disingenuous.
