There were a few variants with software limited battery packs.
The common thing is the battery is limited in top, not bottom. Thats the same for all variants.

The 40kwh battery is the original 2013 60kwh pack.
Then when we got to 2015 and first got the upgraded 70kwh battery with real cells instead of dummy cells in the 60kwh.
Shortly afterwards Tesla upgraded the chemistry in the cells and there were quite a few made that had a 70kwh sticker and a real 75kwh battery with just a slight software limiting.

I dont think they did this on the 85/90 packs, they were all as advertized.
A very rare combo is a 75kwh sticker and softwarelimited 85 pack, only a few of those. Tesla used up inventory of 85 packs.

Recently Tesla had the 60D with a softwarelimited 75kwh battery. This is a real gem as you actually get more than 60kwh from battery.

The 40/60/70/75 packs are all 350V
The 85/90/100 packs are 400V
