i don't think it is right that you should get a refund for generating more then you use. just zero the usage yearly and pay the fees (base charge and back feed charge).
So, I install a solar generating plant and feed electricity to the grid which the utility sells to other customers. I should give it to them for free?
I should be paid at least the wholesale TOU rate.

Despite clear public opposition to a Solar Tax and to making solar unaffordable, the CPUC announced on May 9th that they are still considering a Solar Tax of between $300 to $600 per year for the average solar user, while also slashing the credit for the solar energy sent back to the grid.
This is like taxing people who hang-dry their clothing instead of running the dryer.
