The punchline of the complaint appears to be that Musk made three statements that Hothi claims are defamatory:
  1. that Hothi “actively harassed” Tesla employees;
  2. that he “sideswiped”/“hit one of our people”;
  3. that a sideswipe “could easily have been a death with 6 inches of difference”/he “almost killed” Tesla employees.
Musk attys claim the first two are true, and the third is opinion rather than defamation. Indeed it seems to be that third is indeed true, as a statement of the possibility of something, i.e., that it "could have been" only means that it not be impossible, or indeed here, could easily have been possible given an adjustment of 6 inches.

The case seems like an utter loser, but not surprising the case is driven the most publically wrong people on the planet.

Will be amusing to watch. There was a hearing scheduled for today and I can't tell if it happened or was rescheduled.
