Unfortunate that I had to go through this process-but refunded by CIBC VISA. I fully endorse them removing the software as I don't believe in free lunches.

Remember Banks are regulated also, I've found in certain cases that you can file a complaint with the Federal Reserve and suddenly a bank is all friendly and apologetic. I opened an account with a bank that starts with P and ends with C (with an initial in between) that promised a free $300 spiff after 90 days if you made 2 debit card purchases a month and had a direct deposit to the account. Come to the end of 90 days they told me the account, which I opened at a Branch, with a P?C Banker Associate, with the spiff in hand was opened as the "wrong type" of account and they wouldn't honor the spiff. Went on line, filed an online complaint with the Feds, 2 weeks later I received my refund. Have had similar experience with insurance companies (the one that starts with a 'B' totally mangled my policy and then at the end of the year claimed I never had a policy, and of course you can't really talk to a member service person you always talk to someone who emails something to someone else). After 2 months of back and forth filed a complaint with the state insurance commission, 2 weeks later everything was fixed. I live by a couple of points; don't autopay (I push payments to merchants through a 3rd party, paytrust). If you have to autopay put a low credit card on file, and make sure it's with a reputable bank (I've had nothing but good experiences with AmEx and Chase having my back), document document document. Dispute at the first sign of a real issue (I mean don't be a d*ck but if you're being ripped off immediately avail yourself of your rights). Go over the bank's heads (and googling the officers of a company and then emailing the CEO often also gets you a really quick response, usually there's an "office of the CEO" who's whole job it is to make complaints go away, I've actually had good email conversations with CEOs of major corporations and believe we both walked away winners). Your local Attorneys General's Offices probably has an online complaint form as does the consumer protection bureau (or whatever they're called this week).

I have posted this before but Tesla drafted (attempted) $85,000 from my checking account instead of from the finance company. I did not have that much in my checking account and it froze everything. The next day they did reverse the charge and also unbeknownst to me refunded $2500 of my down payment.

The day before delivery they called and said I needed to transfer back what I "Owed" or they were not delivering. I did and they delivered but not before they refunded another $3K of my downpayment as delivery was occurring. When the delivery SA left my home he said he got a call to have me call the sales office there was some issue but he was leaving the car because all paperwork was signed. So I called Tesla....ha ha ha ha right, they answered on the first ring... ha ha ha. I heard nothing from them for a few days and then some higher level finance guy calls me with a very serious tone saying I owed Tesla money yet I had the car and what was I pulling...?

I told him the story and he was unimpressed and just asked when I would return the money. At this point the car was legally titled to me and they had been such jerks over their own mistakes with zero apoIogies that I considered not giving it back. I told him I had no idea wether or not I had actually gotten an extra $3000 on top of the $2500 back and what ere they pulling? I would have to research first as he had provided me with no details or account numbers. His tone remained suspicious and I hung up.

Within moments I had an email from my delivery specialist with wiring instructions and a reference number to use when paying, asking for a return confirmation email and my reference number once the payment was sent. I discovered they did indeed return $3000 to me after all paperwork had been finalized and signed, and the car delivered.

you should have told tesla "sorry, once that $3k hit my account, I have a policy of no refunds."

goose, meet gander. lol.
I'm sure they’d “mistakenly” hit him with an unauthorized FSD upgrade on his credit card

I wonder if its possible to call the credit card company, pro-actively, and give them a heads-up that if such a charge does happen, to blacklist it or reject it as fraud. I might call mine just to find out if this is possible. it may also be possible to get a call from the credit card company if a charge beyond X amount is attempted.

wonder how we can ensure our safety in this madness?

I do have an email alert set to $500 USD and when I called the bank they said they notify me AFTER the charge has taken place (that's useless) they said they are working on the technology to be notified when a charge is being made but they are not there yet. This is a Barclays Mastercard account.

my guess as to why they do it post-sale, is that they don't want to slow down the 'usual path' (fast path) of when you do want the sale to go thru. if they had to do an inline blocking 'if' and it took time, that would annoy people (that would be their reasoning). so, that's my guess as to why they don't (and won't ever) have it *before*. they want the sale to happen and then have *you* spend more time undoing it. maybe some times you'll just not put the effort in and the sale will go thru even though you didn't want it. they do that stuff (sigh)..

I can't tell you how many times my bank has stopped a legitimate credit card purchase in its steps as a fraud for me, and it is very annoying. I've been on the phone with the fraud department while placing an online order for a third time as they assure me everything is set so it will go through and it is still rejected and they can't explain it. Be careful what you wish for.

... Though I'm a bit disappointed that a charge back STILL seems like the only recourse here...

Even Tesla support will tell you, charge back.. Their online systems aren't the greatest, if you read through the link I posted earlier in this thread. The website has flaws, and the app is simply processing the order straight through the website (in fact, I've been able to get it to reveal 404 errors and other weird errors on loading the upgrade page through the app).

A few months ago, as I mentioned, I had 4 model X deposits charged to my card, even though I only placed 2 (one was refunded for being out of region, hence the second), but both got charged twice. Tesla had no record of it in their systems, even though AmEx showed the reservation numbers assigned, Tesla couldn't find 2 of them. So, charged back 5k. As of last month, those 3 other X vehicles now appear in my account. The cancelled one, and the two that never existed.

I'm still kicking myself over not going through the bank when this happened to me last February. Haha. Glad you got it resolved!! Though I'm a bit disappointed that a charge back STILL seems like the only recourse here...
Thanks. It is interesting that sone of the Tesla fanatics belittle you for complaining about anything. The purpose of my post is just to educate (and at the rime be educated) on what recourse you have. It was an easy fix but I wished I had this info when I noticed the charge. Got stressed over nothing

It happened to me as well. On a rainy day trying to get 8 month old in a car while my phone with Tesla app open in my hand - I accidentally ordered Speed boost for$2k. The worst thing about the whole thing is experience with Tesla. haven't even got the software update yet but they will not refund. Didn’t expect this from Tesla. Given that there are many people posting similar accidents - it’s a total scam from Tesla
