Last night I was rear-ended by a HOV Lane Cheater. She hit me at over 70mph.
I was traveling at 58mph, and then slowed to 43 before impact. As you can see in the video she came in HOT, and didn't even attempt to break, we estimated her speed to be in excess of 70mph. The only positive note to this is that I suffered minor injuries mostly minor whiplash and some arm muscle pains. Doctors say 2-4 days to get back to life in full.

The bottom line is -
Two identical used cars are for sale. One wrecked and repaired (car fax confirmed) and one not damaged.
A used car buyer (or trade in dealer) is going to offer less do the damaged one. Even though claims are made that it’s repaired “as good as new”.
That reduction in value is knows as “diminished value”.
My understanding is the laws vary greatly by state.Thanks for explaining it. So, that's something the insurance companies would reimburse you for but it requires you file a claim for it?

It's not something they typically will say, "Oh hey, and here's some extra for your diminished value." You typically have to make a demand for it, then they might either ask you for "proof" or make their own appraisal from a third party. It's then up to you to make your case. I've gone through this twice and collected both times. Your case for DV is helped by the newer the vehicle, the less miles on it, the more the damage, and the more expensive it is. Of course, like mentioned earlier, the idea is that your car will take a hit with resale value since it's been in an accident.
A diminished value appraisal will cost a couple hundred dollars, but it helps your case. I used this guy twice and collected on both times.

Sorry this happened, but glad you are ok. Were there other cars directly in front of you? If not, would the Model 3 automatically accelerate and lane change to help avoid the impending collision? Sorry if this is a dumb question, but I am new to the world of Teslas. Regardless, I'm just glad no one was seriously injured.
Still dealing with insurance from our accident in Mesa with our brand new 3. It was totaled and they paid for a new one, but still dealing with liability. I think it's very possible yours might be totaled. Especially if you mention you will want DV.

Damages:
Frame Damage - Rear frame is coming out of the back bumper, she hit that and what caused her to cue-ball off me.
Quarter Panel has great big dent and creases.
Lift Gate is Bent
Rear Bumper is destroyed
Both Drivers side doors stick and creak now when opening and closing.
Diags report an air leak in the suspension and camera issues.
Door lines are no longer straight and even.
Lift Gate lines are no longer straight and even
The entire left side is pushed forward some causing the lines on body panels to be misaligned.
Has vibration and pulls to left while driving.
This does not include the damage that is hiding underneath. I have no idea what's there.
My general thoughts have me thinking it's totaled as repairs would be many months, and it would never be the same.
I'm not a crash investigator, but I have stayed in a Holiday Inn Express before.
Upon reviewing your video frame-by-frame, I'd estimate the difference in speed at the time of impact to be between 15 and 20 MPH. Prior to the incident, her speed appears to be matched to yours at just under 60 MPH. As you slow down, she clearly does not. It seems that your dash cam speed display lags your actual speed by a few frames in the video, making it appear as if she sped up. Comparing your change in speed to traffic around you, the lag in the display becomes clear. There's no way she was going 70 MPH unless she floored it at the same time you started slowing down.
I think your travel speed at impact was about 30-35 MPH and hers was about 50 MPH, as she appears to hit the brakes moments before, scrubbing off a bit of speed.
