Dirty Tesla has a 3 and said he has it blocked with tape. So that can't be the only measurement used.

There can be false negatives (in this case failure to detect unsafe driving behavior), but a positive signal of extended phone use while FSD beta is active could be enough "evidence" to kick someone out. Unclear if it is nuanced enough to determine that distracted behavior while sitting behind another vehicle at a red light is not as unsafe as higher speed driving with pedestrians nearby.

Right, but my point is that if you have it blocked off, you should be forced to remove the block if it's a metric they use.

That email is the confirmation that the car has joined the EAP program, not that it has received any beta SW to test, including fsdbeta. This seems different than what Elon tweeted re “the button.” That didn’t seem tied to EAP only, rather to those with FSD who want to download that SW.

Yeah someone I know got into EAP via this but hasn't gotten the beta. YMMV, etc.
