Bummer about the issues. Assuming the spoiler was factory installed, schedule a service appointment through the Tesla app and have the service center or mobile tech fix the issues. These seem like manufacturing defects that should be covered under warranty.

Welcome to the site!

A Performance spoiler pulling away from the trunk lid is fairly common; happened to my car as well.

Fortunately (or unfortunately, depending how you want to see it), the spoiler is held on to the trunk lid with double sided tape. There are no holes to secure the spoiler to the trunk. This means there is no possibility of water intrusion. If you mean the water making the spoiler pull away from the trunk more, I'm not familiar people having issues with spoilers pulling away to a point where the spoilers fall off. If it does happen, I don't believe it is common.

The plastic piece may be plastic used to protect the spoiler prior to assembly. You should be able to pull that plastic piece off without issue.

If the spoiler pulling away from the trunk bothers you, you can schedule a mobile tech to come out and replace it (assuming you are in a service area). I had a tech come to my place to replace the spoiler and the whole experience was smooth.
