He cut across a double white line, it's true, but you basically ran into his rear end, auto pilot or not. This will be thrown out quickly and I wouldn't invest a great deal in lawyers because you may get stuck with a bill much higher than anything you get from a lengthy court battle. I've seen far more cut & dry cases end up being lost so what you have here is not a guarantee. Far from. I know you want to blame the big bad truck driver for singling you out in your EV but the reality is you could have and should have stopped in place where you were. Accelerating into him is akin to intentionally hitting someone, regardless of if they're fully in the lane or not.
I don't think the law works this way... (but I could be wrong)Drivers often do not follow rules of the road (changing lanes in intersection, turning across double yellow, running red light, squeezing a turn in at a red light, etc), which makes full self driving challenging. Fault on truck for changing lane at improper location and not signaling, but fault on Tesla for not manually stopping. You're both at fault. I think all manually driving car drivers would have stopped, honked, get pissed off, let it go, continue on their day. It's like driving down the road, and someone decides to make a left turn out of a parking lot but made a bad decision and started turning too late, and you see that you will hit them because they won't make the turn in time, but you decide to t-bone them because you have right of way even though you could have stopped.
Agreed 100%.Let's take this a step back and not debate right or wrong because in a court of law this can go either and often goes in directions you would not believe even in what otherwise seems like slam dunk cases.
You have insurance, right? Contact them and file a claim. They will cut you a check less your deductible and then they themselves will handle everything else to get paid by the other driver or his insurance. If they can get the other guy's ins to admit fault prior to cutting you a check they likely won't even deduct your deductible. Who cares if they sue the guy or get an agreement with his insurance company in this instance?
Life is short. This is exactly why you pay full coverage insurance premiums. Use it.
The rest of this BS back and forth is just static and wasting time.
You must notWhy not?
It’s not unreasonable to assume they didn’t feel they hit you, you chase them down and show them the footage.
Also the damage to my car is on the side. Not in the front of my car.If you pay attention to the video, that’s not true. The collision was from the side, not the front(in the video, you can even see the scuff marks from it on the side of the truck). Since the truck was moving to the side and OP was not, it’s the truck that collided with OP.
Gotta ask - why not just let the insurance company deal with this instead of hiring a lawyer?

The truck driver also crossed TWO solid white lines which is an illegal lane change:
Double white lines are two solid white lines that indicate a lane barrier between a regular use and a preferential use lane, such as a carpool/HOV. Never change lanes while in these lanes; wait until a single broken white line appears. You may also see these parallel lines in or near freeway on and off ramps. California Driver Handbook - Traffic LanesThe only thing is his defense is these long bed double cab lifted trucks are HEAVY and literally "ride like trucks"... leaving the possibility the that maybe driver didn't really feel the collision especially since they were focused on changing lanes. MAYBE.
Sadly California Highway Patrol policy no longer responds to OR writes tickets for non-injury accidents even though traffic laws are broken. When I called 911 after being rear ended in L.A. while still on an offramp of the 5 freeway last December they asked "Is anybody injured?" and when I responded "NO" they said "exchange insurance information with the other driver... CHP doesn't respond to minor accidents".
However the fact that the driver of the truck violated traffic law should make it a "slam dunk" at fault accident.
I agree that he could possibly have avoided the accident if he had disengaged autopilot, but that doesn't make it his "fault".
I don't think it would be unreasonable to state that you were not expecting another drive to cross solid white lines into your lane and cut you off.
I'm not sure how these situations are supposed to work if the two insurance companies can't agree on fault. Is there some established procedure in these cases?

This is the best position to take.
Also I would file with your own insurance company and provide them the video so they can subrogate the claim with the idiot in the pick up truck. Also I find it hard to believe that the pick up truck did not feel this accident given that a Model S weight about as much as a pick up truck.
Let your insurance company deal with it and the video clearly shows the pick up legally cut across lanes to cause the accident.
