I would insist it is covered. It’s a design flaw and of no fault of the owner. Thankfully the garage here in the UK took full responsibility and are actually replacing the entire tailgate as part is bent.

Same happened to my 2022 M3 today. Just a routine open and close. The trunk actually got stuck and took a few attempts to open. Only had it a month……
