    It would, though in the absence of taxable income, Tesla is unable to benefit from tax credits. Presumably Tesla would work with a (profitable, taxable) leasing company in years when Tesla has no taxable income.

    The issue is that Treasury Dept. has determined that leasing IS a commercial use. Thus, leasing companies are eligible for the CCVC, which they may pass along to the consumer in the form of reduced lease payments. See Topic G, on the last three pages of the IRS fact sheet...

    Kind of like saying production will "ramp up" "soon"? It's not always possible or appropriate to speak in full, specific detail. That goes for reporters as well as CEOs. When you don't have perfect knowledge, you report what you honestly can, to your readers or to your stockholders.

    The same thing that would happen if the agreement were subsequently revoked, after the judge's signature. A reversal would be made in the subsequent accounting period, if appropriate. What 'seems like it would make sense' is quite frequently different from what GAAP requires. ;)

    Do you mean 'Q3 profit effect'? GAAP requires costs be recognized when they are incurred. Since the settlement was agreed to in Q3, I expect Tesla's accountants will reflect the $20M cost in Q3. I don't see any wiggle room here on the timing under GAAP. Do you?
