Yes I'm pretty sure the date that matters is the date you actually take possession. From the warranty:

The effective date is 1/29/2020.

I am trying to hope here here but:

date of deliver/possession is not my decision as I have passed all requirement to purchase and all I wait here is them to deliver the car.

My decision at the time of purchase was done with the info of the old warranty terms.

but you haven’t signed for the car. You can cancel if you aren’t happy with those terms.

Got a confirmation that since I ordered before the announcement I was keeping the old warranty clauses.

Now the big question is witch warranty is better or the old???

If you put on average miles, I’d think the new one is better. There is no specific degradation warranty on the old one.

Some owners had a hard time to get Tesla to honor the old infinity mile because it doesn't specify the minimum capacity.

His new MS85 had a spec of 265 miles and it was down to 179 miles then down to 139 miles and died on him but Tesla initially rejected the infinite mile warranty :

"so the car could get down to 50 miles of battery range and you could say it is just degradation. The response was, “yes”."

Tesla eventually covered it after 30 pages of forum discussion!
