The refund of my deposit was based on my specific and unique set of facts. I made an argument as to why my deposit should be refunded and Tesla agreed. I do not have a general "cure-all" to offer.

Basically, if Tesla failed to deliver on their part, you can weasle your way out of the deposit being "non-refundable". They've already given me a few outs, so I am window shopping atm. If there is a better deal out there, i'd drop the cpo.

wish i was in the market... a PLUS suspension on a P85D is in my opinion the best Tesla ever made even today... it is the ONLY car I would consider trading my P85+ for... Great car at a good price... GLWS...
