Are smiles and happy family activities of people with medical problems in medicine commercials staged? Yes? OK, case closed.
If you're depressed and you take an antidepressant that you saw in a commercial where everyone in the commercial was smiling and happy and laughing, can you sue if you don't feel happy, claiming the commercial was misleading or fraudulent?

You can, but you will (or should) lose - that's my whole point.. They will say that it's just a staged situation and you shouldn't take it literally in the sense that it will be exactly the same for you, it's just an illustration of the message they are putting across. Same here - we see the car is self driving and it explains how the driver is not doing anything. It doesn't say much else, it's an illustration for you to see the car's eventual abilities. Of course it can be staged, animated, edited - it is not a documentary, it's a commercial.

Drug companies get punished all the time for fraudulent marketing. I don't think that's the best example to use. haha.
OK, let's find a different example: an actress is drinking juice in a commercial and apparently likes it. But she may just be drinking some colored water. It doesn't really matter - they say you will like the product when you buy it, not that the product they are using for filming is real. In Tesla's video, they say that the driver is not doing anything, and it is true. The fact that the path may be hardcoded is irrelevant - it's just an illustration. That's the point.

I am not - I specifically paraphrased it in my reply ("they say that the driver is not doing anything"). What exactly is incorrect in that sentence? Do you think he secretly drove the car? That he is needed to be in it? No. The car drives itself. It is just not driving itself in a random situation, but on carefully prepared route where they made sure it would work. Nobody said or wrote otherwise in that video, especially not in that sentence.

The driver was not there only for legal reasons. It did not work on the carefully prepared route.

If they're taking sugar pills in the ad, and you include a text saying "these are actually SSRIs, but the label is there only for legal reasons", and then you use that ad to sell sugar pills, obviously you should be sued.

Where did that video come from? That's not the 2016 demonstration video it looks fake, here is the "real" one- Tesla Self-Driving Demonstration | Tesla

So they made two different videos demonstrating FSD back in 2016? I would think that would make them look worse as far as falsely advertising. FSD and give plaintiffs twice as much evidence. They really haven't progressed in 6 years though they regressed if anything. Especially the autopark it doesn't even do anything now nevermind drive around looking for a parking space on its own.
