Your outer rolling diameter will increase with the taller sidewall, therefore throwing off your speedometer reading. If you want to go taller, need to go narrower tread as well to keep the relative diameter as close as possible.
Sidewall height difference between 40 and 35 is really only about 1/2" so if you are thinking of better wheel protection for potholes, don't think 1/2" difference would make much difference.
Consider wheel well clearance is very tight, especially fronts while turning.
I had wheel rubbing issues with the correct size when I first purchased winter tires.
