Also, to claim the Auto Pilot has no malfunctions when it collides with another vehicle and that it is 100%responsibility of the driver why would Tesla claim Your Tesla will match speed to traffic conditions, also there was no alarm of a near collision. Surely one of these must indicate there is a malfunction?

Yes, there was maybe a malfunction, that's why Tesla goes through so many methods to tell you that you must still be aware.

Why didn't you hit the brakes? What were you doing?

Were you not following the instructions? If not, why would you expect that car to?
Sorry, you are about to have some possible legal and insurance issues.

Several good comments, and appreciate the quotes from the manual. There is no defense to claim that the driver is not responsible while driving the vehicle. The question is, if speed assist, and collision avoidance are stated to be “safety features” of the vehicle and these do not operate as stipulated, does this excuse all liability from the manufacturer? Please let me know who has not at any point while in Auto Pilot, had hands off the wheel and been distracted for even 2 seconds? Perhaps I had a completely false impression of what “safety features” are. The caution issued here is do not rely on these features as being safe in any regard at any time. For those of you that operate in this manner as with any other vehicle that’s great.

Regarding the prior cruise control question; it does not use a speed assist feature which Tesla states is a “safety feature”.

A safety feature helps prevent the situation from occurring, it doesn't necessarily keep it from occurring. A safety feature tells you to pay attention and hold the steering wheel, that helps you from having an accident, it doesn't prevent you from having one.

Sorry, but you are talking to a bunch of folks who really want the full self driving feature, but readily know that it is NOT AVAILABLE at this time.

By the way, there are a number of other vehicles that have the same functionality as the Tesla today, in regards to "self driving" capabilities of adaptive cruise control and smart lane guidance. My 2018 Leaf even has it. And everyone of those says the exact same thing "It's the driver's responsibility to drive!!!!!"

Until you are not required to have a license to operate a vehicle, you will be responsible for the safe actions of the vehicle.
