Your zeal to make sure people are not hurt because of timeline disappointment is admirable but I think there's a difference in Tesla's case.
A scam has no intention to fulfill its final product.
Tesla has missed its projected timelines but its intention has always been to honor and fulfill its final product.
Just because the final product has missed its timelines which is very disappointing but that does not mean Tesla has shutdown its Self Driving Department after getting paid.
Another good example is in 2017, SpaceX already took the money for 2 civilians to fly to the orbit of the moon for 2018. But at that time, they had no rocket that was powerful enough to do that and they still have no manned capsule even in earth's orbit just yet.
It could be misinterpreted as a scam because all of the requirements for the moon orbit was not yet tested out or even existed so how could SpaceX take the money?
Missing timelines happen quite frequently with Elon Musk but his record has been good in fulfilling his goals if you give him some time.
