Can any "expert" here look at the attached exhibits in the lawsuit including the EDR report and deep gash marks on the road to determine if it's Tesla or the actor at fault?

From my limited understanding, it does look like the Model 3 suspension just "peaced" out causing the crash. However, it also looks like the guy accelerated from 30-50ish MPH right before the crash. What am I missing?
