Misleading/False Information on my Used Tesla Inventory Purchase

So last wednesday, I accepted delivery on my 2016 Tesla Model S 75D. I specifically went for the 75D because I saw that the car post-facelift received a performance upgrade to increase the 0-60 time from 5.2s to 4.2s as seen by a car listed here: 2016 Tesla Model S 75D Uncorked 25k miles, here: Uncorking official for most 75Ds! and various articles on the web discussing it (not sure if I can link those). To me, this made the 75D a much better value over the 75 as that was a big performance gain. So after picking up the car, I went and checked to see if the car had received the uncorked upgrade using this: Uncorked: Thanks TMC Friends!. I saw that my perf_config was p3 which means it had not received the upgrade. So I thought thats fine I'll just schedule a service appointment and see if they can get that done. A day after scheduling I received a call stating that my car was not eligible for this upgrade. Now what annoys me about this is that on the Tesla Used Inventory listing, it states that the 0-60 time for this car will be 4.2s implying that the car has received the upgrade and since it hasn't and is unable to, I feel that this is a case of false advertising. The only reason I went for the 75D over the 75 was because of this gain in performance as AWD is not necessary where I live meaning I could have saved money by just going for the 75. Is there anything I can do about this? I emailed my Delivery Specialist about it and he said he would call me but I just want to know if I'm crazy or am missing something. Thanks

Here is a photo of my listing:

Oh wow. That sucks. I thought that all facelift "D" cars were uncorkable. Yet another potential landmine for those trying to navigate the Tesla used car swamp.

That's what I thought too. I talked to Tesla chat three times about it and have got different information every time. The first two said my car was not eligible for a "battery upgrade" and the last one said that the uncorking process was discontinued. It's so frustrating.

Yea that’s insane , considering 75s non D are selling for 42-46k .. and you payed $53

I am in the same boat and was looking exclusively for 75d for the performance aspect . Will now be cautious and keep my eyes peeled for 75 non d too..

Hope they can fix it somehow, but it’s even crazier to think all these people who bought 2016 75d’s recently have probably been mislead too.

The more I read this shadiness , the more I want to look elsewhere, shouldn’t happen. Blatant disrespect to the buyer

I would search these forums about uncorking. I got my car Sept 2017 which came uncorked. One of the reasons I got the 75D. I think early in 2018 many older cars were being uncorked. There was some mix up but maybe those threads will help you understand the options. Good Luck.

Note: I might drive to the service center and talk to the manager and explain your situation. You might need to first talk to someone who actually understands how to do the uncorking. Maybe a non-technical reason it can not be done and you just need to get authorization. Just guessing.

This has been a big problem. Pretty much everyone I talked to thinks I'm trying to get a bigger battery. I honestly thought I was going insane and this performance increase never happened. I always have to send an article about it for them to figure it out and then they just say that was a while ago so I don't think we do it anymore.

Frustrating for sure. But they must have some documentation somewhere. This is talked about a lot at the time it was going on. Unless there was some kind of cutoff I see no reason it can't still be done especially with it on the sales lit. Maybe talk to the sale rep.

Yeah you're probably right. I'm gonna contact my sales rep and just really hope they can get it uncorked. Looking at EV-CPO, its seems that a refund might be out of the question because the prices have really increased since I bought the car. Considering I probably won't get the 2500 deposit or the shipping back I'd probably just break even at best.

Yeah looking back at it, I would contact a Tesla rep and have them tell me that the car is uncorked before I even bought it. I even asked him when I was checking out the car before I signed for it and he said "Yeah it should have the performance those were done in 2018" idk why I believed that. Hopefully I can at least save someone from making the same mistake. Good luck with your purchase.

Man this is bullshit. Just call your credit card company and cancel the transaction, don’t wait.

Tesla annoys the hell out of me lately. This is not the company I can support in any way. Blatant and outright lying and misinformation everywhere. Clueless employees on every turn. Demand the refund and cancel, but have your credit card company just cancel the transaction as a safety net.

I would if I could. Unfortunately I already took delivery of the car last wednesday.

It’s like they are selling an item that costs a few hundred bucks where misinformation or misleading will piss a customer off but at the end of the day it’s only a few hundred bucks

They’re selling a car that’s worth 10s of thousands of dollars. They really need to be more thorough.
They need a more informative staff, you shouldn’t get different answers to the same question multiple times, and yet that keeps happening.
Simply unbelievable.

So this got me curious... my uncork was supposedly done back in 2017 during another visit but I just pulled data using the API and also got "perf_config":"P3"

I scheduled a service visit because of the uncorking not being done right, the service manager called me back and said that it has been done as the records show. I explained to him about the API but he didn't seem to care.

Are we 100% sure that P3 means it is not uncorked?
