That reeks of desperation since it doesn't dispute that they modified the agreement to be weaker than they originally wanted. Hopefully, the judge sees through this blatant attempt by the SEC to expand the scope of the agreement.

Their whole argument reeks of desperation. They opened their case in a rush without doing even the most basic bit of due diligence as to whether what Musk wrote was actually against guidance or actually material, and their attempts to shore up their case just keep putting it on ever-flimsier footing (for example, citing as evidence of other "problematic" tweets, Musk listing EPA range figures and explaining how an electric motor works - which in turn gave Musk's attorney the opportunity to introduce the negotiation documents that normally he wouldn't have been able to introduce)

I never discount the possibility of adverse events. But I just have trouble seeing how Musk ends up with the bad end of the stick in this ruling.

So most probably we will have a beat on M3 numbers, but miss on SX numbers from FactSet.

Analysts polled by FactSet expect Tesla to deliver 77,000 vehicles in the first quarter, including 55,000 Model 3 sedans. Concerns have swirled that demand for Tesla vehicles are lagging and margins dwindling.


So on deliveries report SP might not move at all and await for ER.

It is a curious thing, this rap song. The song is out, the stock is moving. CNBC played the song on-air this morning which I would interpret as an endorsement that it is accretive to the value of their on-air product.

EM is appearing as an artist that has a presence in the meme world and beyond where his voice as an artist moves needles of social attention. As an artist and a personality (even as a humorist), his very existence is material on various social vectors. Silencing EM in any way would seem problematic.

Our world of social media, the meme-verse and the intersection of the business world with celebrity complicates any nuanced ruling by the court IMO.
 
Elon should offer FSD as a service


Right now buying it up front helps Tesla's cash position much better, but I suspect someday it will be a subscription service. Having it as a subscription service eventually (along with ride hailing services) will help smooth out a pretty boom-bust industry (car sales).

In the Q4 letter:

"While the number of Model 3 vehicles produced should increase sequentially in Q1, deliveries in North America during Q1 will be lower than the prior quarter as we start delivering cars in Europe and China for the first time. As a result of the start of Model 3 expansion into Europe and China, deliveries will be lower than production by about 10,000 units due to vehicle transit times to these markets."

Only model 3 though.

Just a light bulp moment while trying to figure out why FSD hardware is in cars that didn't even order them. Eventually FSD will be offered as a monthly subscription. Even those who didn't order FSD will find it convenient to order it for a few months on roadtrips etc.

I really want to see those roof trusses spread and get paneled. Because you know that the instant there's anywhere with even the most basic protection from weather, Tesla is going to start setting up lines ;)

Really? Maxwell published specs for their 1st gen dry electrode Li-on cells on Jan 18, 2019 in this PDF (pg. 10 reproduced below):

Note the energy density targets for 2nd gen cells are identified as well (500 Whr/kg), in addition to 2x extended bty life, higher production density, 10-20% cost reduction, and numerous environment benefits.

Maxwell scientists also demonstrated their dry electrode technology at a recent energy research conference, as summarize in this paper:

"Maxwell dry electrode manufacturing demonstrative benefits"
  1. environmentally benign due to elimination of toxic solvent
  2. lower cost by reducing capital and operating expenditures, resulting from elimination of solvent recovery and recycling system
  3. improved energy and power density afforded by unique dense high loading electrode microstructures.
"We have demonstrated":
  • dry robust process capability, incorporating current and advanced chemistries such as
    • graphite
    • silicon
    • metal alloy
    • nickel-rich layered transition metal oxides
  • roll-to-roll dry process scalability using common and advanced battery material chemistries

300 and 500 Wh/kg are for DBE applied to advanced chemistries, not current NCA or NMC. These advanced chemistries are not used in EVs today due to issues of cost, power density, cycle life, etc. DBE does not solve these issues. If you solve these issues independently and build a better EV battery, DBE might help you manufacture it with lower cost and environmental impact.
 
Elon should offer FSD as a service

FSD is a curious phrase. There could be a case made that self driving applies to the empty vehicle. It finds the destination and maps a route that it then travels to that destination. It could be about the car coming to you or the destination of your choice at the time specified.

Picking you up in the parking lot for instance is like "Summon". But driving to the airport to pick you up is more like FSD Summon.

Autonomous driving might be a kind of service that is something similar but different.

I suspect in the future you will get your first month free to try to hook you in.

Hrmm, here's an idea I just had... You know how there are credit cards with "sky miles" points, what if Tesla were to do something similar to that but with superchargers? (and evenutally ride hailing points and AP subscription points)

.......increase sequentially? like, don't they do that anyway no matter how many they produce? isn't that how counting works?
