Absolutely not. If Musk did something wrong, then he deserves to be punished, which will be determined through investigation and prosecution if warranted. Given the accusations, such a punishment would likely be a fine that would be a pittance to a billionaire like Musk. His recent behavior needs correction, and if that means the SEC slaps him with a fine, then so be it.

Agreed. The only way to change his behavior is by accepting all responsibility and consequences of his actions.. and that will make Tesla stronger in the long run. He does not deserve a "bail out" in any fashion just because he's Elon Musk. It doesn't matter how many businesses he started or how many americans he employs -- an illegal activity is still illegal. He doesn't deserve or get a 'get out of jail free' card any more than any of us deserve for doing something illegal.

Anyone who is long in the stock took a massive hit in value today, which wouldn't have happened if he kept his mouth shut. Chances are the stock would still be in the upper 300s if this never happened. His personal actions have sucked tens of billions of dollars of value from shareholders that support the company and his mission. And you want to reward him for that?

Also, as noted, presidential pardons are only for federal crimes against the United States. And Elon would have to be tried, convicted, and sentenced to a federal crime before any pardon could be granted. So this whole pardon idea is flawed on many different levels.

What are the benefits of a pardon?

A pardon represents a full legal forgiveness for a crime, removing any remaining prison sentence, probation conditions or unpaid fines. It also removes other collateral consequences of a conviction, allowing felons to vote, hold professional licenses, run for public office or own a gun.

As a side note, the petition pages claims:

All of the companies that Mr. Musk has founded have created tens of thousands of jobs across the United States.

Mr. Musk was not the founder of Tesla Motors.

As said above, the SEC does not have law enforcement powers, only civil powers. He can be sued for civil fraud which has a much lower threshold of proof (preponderance of evidence, versus evidence beyond a reasonable doubt as is the case for criminal fraud.)

If the SEC determined in its investigation that Elon Musk possibly committed criminal fraud or any other criminal act for that matter, the SEC would refer their investigation to the Department of Justice and the United States Attorney's office for further investigation and possible filing of a criminal complaint.

Unless there are other actions of his that I am not aware of, what he said on his Twitter account does not meet the standard of a felonious act.
 
Ditto, at the top of the pyramid you need to keep composed, especially when millions of lives depend on your actions. Elon will be wise to come out publicly and admit his mistake, emphasizing heavily on work related fatigue as a cause, he is still my hero and visionary!
