Florida owners living in Gated Communities in Palm Beach County that prohibit chargers! Where do you charge your vehicles?

Just a thought. Determine the number of EV owners within the HOA. Get them together and work out a plan to put pressure on the HOA to permit installation of L2 stations. Don't know how many you'll find, but once there are a sufficient number, and the group uses their heads to present their issues in a thoughtful manner, you might well prevail.

Maybe people who choose to live in gated communities are different, but most HOA boards are desperate for people to serve on them. If the existing board isn't convinced, get on the board and change the rules!

Yeah, HOA boards tend to be filled with people who have nothing better to do so the board's perspective is often skewed

The question needs a lot more information to be answered. First, is it just a gated community and the homes are townhomes and/or stand alone homes? If so there is nothing the HOA can do to stop you installing a charger in your own garage. Or is this a condo building with a parking garage or open parking lot?

There is a law if FL that the HOA cannot prevent you from installing a charger. The board likely doesn't know this, but you can show them or the management company the law and they have to abide by it: Electric Vehicle Charging Stations on the Common Elements | Florida Condo & HOA Law Blog

These are the general requirements, and while it might not be cheap to satisfy everything if the HOA refuses to play ball you can sue them and you'll be able to recoup attorney fees:

"Unit owners may, likewise, install their own EVCS in their limited common element (LCE) parking spaces. The board cannot automatically prohibit owners from installing an EVCS in their LCE parking spaces simply because the board installs an EVCS on the common elements. The statute provides that the board must approve an owner’s request to install an EVCS in a LCE parking space, subject to the following restrictions:

  1. The installation may not cause irreparable damage to the condominium
  2. The electricity for the EVCS must be separately metered or metered by an embedded meter and payable by the unit owner installing the EVCS.
  3. The unit owner who is installing the EVCS must pay for the costs of installation, operation, maintenance, and repair, including, but not limited to, hazard and liability insurance.
  4. If the unit owner (or his or her successor) decides there is no longer a need for the EVCS, he/she is responsible for the cost of removal.
  5. The unit owner installing the EVCS must comply with all federal, state, or local laws and regulations applicable to such installation, maintenance, or removal.
  6. The unit owner installing the EVCS must comply with reasonable architectural standards adopted by the association that govern the dimensions, placement, or external appearance of the EVCS, provided that such standards may not prohibit the installation of the EVCS or substantially increase the cost thereof.
  7. The association may require the unit owner to engage the services of a licensed and registered firm familiar with the installation or removal and core requirements of an EVCS.
  8. The association may require the unit owner to provide a certificate of insurance naming the Association as an additional insured on the owner’s insurance policy for any claim related to the installation, maintenance, or use of the EVCS within 14 days after receiving the Association’s approval to install the EVCS. The association may require the unit owner to reimburse the Association for the actual cost of any increased insurance premium amount attributable to the EVCS within 14 days after receiving the association’s insurance premium invoice."

Yeap..exactly...

People complain about HOA Boards and decisions yet they're the same people that don't even attend HOA meetings or willing to put in some time to make a change in their community. Bad HOA boards are often a reflection of the lack of involvement by the rest of the community and that's how you end up getting that one or two people that have nothing better to do and go on a power trip. The community can easily vote them out but they don't care enough to do so...

CC&Rs aren't changed often so they're not always up to date with all of the changes from a legal standpoint and sometimes they just need to be informed about the recent laws in your state...

While waiting for the HOA board, go to the FPL EVolution website. They have conveniently located charging stations in PBC. They have an app related to this. It's probably easier to access vs the Tesla supercharger at the PB Outlet Mall. One site is at the PBG office off Military HWY, where there is a farmer's market on Sundays-charge and shop locally !

I'm assuming that a gated community in Pam Beach County means that everyone has a garage. Just put in a 240v outlet. That will get you plenty of range overnight. Don't you have that for your golf cart anyway? 😎
Not always; My parents lived in Palm Isles (I) and there are mostly two story buildings with 8 garden apartments each; attached villa style homes and single family homes. Only the single family homes have a garage. Most of the vehicle parking is in front of each building. Carports shield the vehicles from the sun but under the latest building code covered carports can no longer be built due to hurricane force winds ripping up the roofs on the car ports.

ever watch Seinfeld? Many episodes about Jerry's dad trying to get on board, and his attempt getting derailed when his son gave him a Cadillac.

HOAs comprised mostly of retirees with unlimited free time are a bit different from the regular ones. And combine the maga politics and the rather common anti EV sentiment of the silverbacks, it would be very difficult for the handful of EV owners to get a coalition together on this matter. "But those 4 flooded cars burned up after the hurricane!"

Our condo is on the third floor of a three story elevator building with eight apartments on each floor with a townhouse on each end of the building on the ground floor. Running a 240v extension cord from the third floor down to a parking spot in front of the building is not allowed. The present BOD is not interested in EV charging stations. :(

Then I guess your only option is to get on the board and advocate for a change, or charge off-site.

Yep. The energy industry almost got an anti-net metering bill passed, it did pass their Legislature but fortunately, DeSantis did one right thing and vetoed it.


I keep asking myself, why do I want to retire there?! :oops:
