It’s this part right here. That’s a lawyers dodge if I ever seen one. What are those other factors…I know my car wasn’t getting 400 on a full charge but it was north of 350. You can’t get that without getting me a 100kWh pack. I may be wrong but we shall see.
Tesla maintains the average range for the variety of vehicle configurations. Let's say that the average for your class of cars is 350 RM. If your car had 370 Rated Miles before the failure you are entitled to get at least 370 miles. You are not the only one in this situation and others have been reporting to have received packs with the RM at least equal to that of the original Battery before the failure occurred. I know of a few unlucky exceptions, but those owners went back to Tesla dissatisfied, and with a copy of the document I posted above, and got a better pack with the range at least equal to that of their original Battery before the failure occurred.
