Musk, Tesla shareholder to propose a stay of pay ruling during appeal

Elon Musk and the Tesla shareholder who won a verdict last month voiding the CEO's $56 billion pay package will ask a judge to pause her ruling until an appeal is resolved, according to a Tuesday letter to the court from the shareholder's attorney.


Greg Varallo, the shareholder's attorney, said the two sides will agree to a stay if they can reach a deal on an appeal bond.

The letter is the first indication that Musk intends to appeal the ruling, which the billionaire has criticized on social media, saying he will seek shareholder approval to move Tesla's state of incorporation to Texas, where it has its headquarters.

Confirmation from Tesla's VP of Public Policy and Business Development that FSD Beta was not downloaded to the car in the accident:

That seems to make it clear that somebody, maybe Dan O'Clown, wanted this incident listed on the NHTSA reports so that they can point to it and say FSD was involved in a death. (I think the whole basis of the NHTSA data indicating that ADAS was in use sometime within the 30 seconds preceding the collision is ridiculous. 30 seconds is a long time, and depending on the situation it could be very clear that ADAS wasn't involved even though it had been active 30 seconds ago.)

Tesla itself submitted the report like that because the NHTSA SGO is very broad:

"Engaged,” for the purpose of determining whether the ADS or Level 2 ADAS on the subject vehicle was “engaged,” includes crashes in which an attempt was made to engage an ADAS or ADS to transfer partial or full control to an ADAS or ADS system, even if the attempt is rejected, aborted, or underway during the 30 seconds immediately prior to the commencement of the crash through the conclusion of the crash.

Probably part of the reason Hertz reduced it EV rental fleet. A lot of confusion and ignorance among customers. Especially the rental return process and you are not used to buying out 20 minutes of time to recharge before returning the vehicle.
 
The next paragraph tells me the reason... Recall Remember, there was no award given to the plaintiff in round one.

"Before Musk can appeal, the two sides will propose a final order for approval by the judge, Kathaleen McCormick, which will include a petition for a legal fee. That fee will be paid by Tesla and given the enormous verdict, it is likely to be among the largest ever. It will likely be opposed by Tesla.
 
I saw that local artwork. I think it would be cool if Tesla saved some of the wall, or recreate a part of the art in lights/hologram. Would be an inclusive move.
Vote to pick the best one, keep that one around I say.
What if Tesla provided a wall and tagged it themselves ‘This space for artists. The piece that represents Tesla the best will be used in a marketing campaign.’ Or some such - what about an artist per charging stall can do their art on the pavement? Free advertising and an aspiring artist/s gets rewarded. The possibilities are endless. Turn vandalism into an opportunity to do better and have a better life.

38% is massive considering the relative lack of personal experience, FUD & understanding of EVs. Also shows that percentages based on NEW vehicle buyers are different from surveying all people (many of whom would buy second-hand).

... not to draw a conclusion that 2/3 are yet untapped or that .64 x .38 = 24% upside if they only knew more.

It is also possible that 64% of the population cannot afford a new vehicle (ever, in their minds) or that knowing about EVs changes anything when compared to existing buyers. Maybe we could say that this introduces 0-24% upside with some first-hand experience, but I would skew it to the lower end due to poverty.

For example, here's a group of folks that will likely only robotaxi EVs in the future once costs get down to 5 cents a mile (SWAG but not far fetched, plus "5c a Mile" would look cool on the side of them).

If you are interested in a single image or short video on why unboxed is the future. This is from the video linked above at this timestamp. The entire line has to stop for this chair to move into the vehicle. Notice the worker tilts his head as the chair moves in (looks like he is looking at a mirror to be sure he doesn't hit his head, but at that angle it would be hard to tell and he's not wearing any protective headgear) and controls the motion of the chair with their foot. This chair holds the line when extended and has to be calibrated for each vehicle and each worker has to be trained on the chair. All of this is gone with unboxed and this is more than likely done with a robot.

If true, that only <40% of people are aware of EVs, and Tesla has >4% US market share (CNCDA data end of 2023), then Tesla effectively has >10% market share
