Tesla Unionization

So 20 union members at Hydro Extrusion Sweden are getting fired thanks to the union caring so much about 15 of their members not getting their collective agreement.

Småland's Tesla supplier Hydro Extrusions notifies 20 employees of layoffs, reports Sveriges Radio. The decision is connected to the strike, according to the CEO.
- They do not need to notify, says IF Metall's contract secretary Veli-Pekka Säikkälä, adding that the union offered to pay the salary costs.

20 out of approximately 600 employees at Hydro Extrusions in Vetlanda are notified of dismissal because the company was given less to do. Deliveries of the company's aluminum profiles to Tesla's factory in Berlin have been blocked by IF Metall. This as part of the major conflict the union has with Tesla in order to reach a collective agreement, something the American electric car giant refuses.
- It is directly connected to the Tesla conflict, says CEO Jonas Bjuhr to the radio.
The union's blockade against the company has been going on since November.
But the notification is unnecessary, according to Metall. Veli-Pekka Säikkälä points out that the union has offered Hydro Extrusions to pay the wages of those affected so that the company can go unscathed.
- But they don't want that, he tells TT.
He believes that management is under "strong pressure" from Tesla to force the union to back down.
- But we will not lift the blockade, not at the moment anyway. It is useful, says Säikkälä.
On Thursday, Tesla announced that the factory in Berlin will pause production for a few weeks. Reason: There are missing components for the production as a result of the shipping problems linked to the conflicts in the Red Sea.
Veli-Pekka Säikkälä is not convinced by that explanation. The products that Hydro Extrusions manufactures are unique in all of Europe. If nothing comes from Vetlanda, it will be a problem for Tesla.
- It is not excluded that it is connected, he says.

Municipal council in Vetlanda sends an open letter to IF Metall

UPDATED TODAY 05:27PUBLISHED TODAY 04:52
Robin Wallén Nilsson (M), chairman of the municipal board in Vetlanda, today sent an open letter to IF Metall where he wants them to withdraw sympathy measures against third parties in the Tesla conflict.
- I think it is important to highlight that the conflict now affects third parties who actually have a collective agreement, says Robin Wallén Nilsson.
In the letter to IF Metall, the municipal councilor in Vetlanda calls on the trade union to remove the sympathy strike against third parties. He refers to the fact that the company Hydro Extrusion today notified 20 employees and refers that they are taking the action because of the ongoing Tesla conflict.
But should you, as a politician, get involved in a conflict between the social partners?
- That is a good question. But in my position I represent Vetlanda and the interests that exist in this municipality. And when it hits third parties who have collective agreements, I want to react.
What do you think that Tesla has so stubbornly refused to sign a collective agreement?
- I stand outside the discussion here, now it's about how it affects third parties and affects Vetlanda.

Looks bright on Vetlanda's future

Even though Vetlanda has been hit by a lot of notices and a few bankruptcies recently, the chairman of the municipal board is optimistic about the future.
- It is sad and difficult for the individuals who are now losing their jobs, but I am convinced that things will turn around and that Vetlanda will flourish in the future, says Robin Wallén Nilsson.

Pro Union newspaper:

So the union offered to pay the salaries for the workers who got laid off but they declined because Tesla put pressure on them. How? By them cancelling their orders and Tesla choosing another supplier? How could Tesla put more pressure on them than that?

Tesla supplier notifies due to strike

Hydro Extrusions notifies 20 employees of redundancy. According to the CEO, there is a direct connection to IF Metall's blockade which stopped the company's deliveries to Tesla. But the notice is unnecessary, the union believes.

Since November, IF Metall has blocked all production of aluminum profiles at Hydro Extrusions in Vetlanda . This is because the parts are delivered to Tesla's factory in Berlin and constitute an important component of the crash protection in the cars. This is reported by Vetlanda-Posten .
The blockade has hit Hydro Extrusions hard, says CEO Jonas Bjuhr to the newspaper. Now the company is forced to notify 20 people at the factory in Vetlanda.
- We have done the right thing and have our collective agreements. We are affected by a conflict where we are only affected and cannot influence. It is our frustration, says Jonas Bjuhr, to Vetlanda-Posten.

Offered to pay

But IF Metall's contract secretary Veli-Pekka Säikkälä believes that the notice is unnecessary. According to him, IF Metall has offered to pay the salaries of the employees, something Hydro Extrusions is said to have refused.
- They didn't want them, he tells TT.

The union: "Will not lift the blockade"

He believes the explanation is that Hydro Extrusions was subjected to heavy pressure from Tesla in an attempt to get IF Metall to back out of the conflict.
- But we will not lift the blockade, not at the moment anyway. It is useful, says Veli-Pekka Säikkälä to TT.

---

Also the Hydro Extrusions Norway comments:

"The sympathy actions from IF Metall have irreversible effects for Hydro. It is not necessarily the case that once the strike ends, production will start at the same level as before the strike. We do not produce "off-the-shelf" products, but specific parts for specific customers. This has long-term consequences, which go beyond a period of strike, so the offer to pay wages as long as the strike lasts is less interesting for Hydro.

This is not a means of pressure from Hydro in any way. We see a general decline in the market, and the conflict with IF Metall adds extra weight to an already strained situation, which leads to redundancy at Hydro in Vetlanda. We are therefore forced to reduce staffing.

Kind regards / best regards

Hydro Extrusion announces layoffs. In a press release, the company writes that the decision is a consequence of IF Metall's conflict with Tesla. IKEM – The innovation and chemical industries demand that IF Metall lift the industrial action immediately.

- IF Metall has caused extensive damage to collective agreement-affiliated Hydro Extrusion, which is now notifying approximately 20 people of termination, several of whom are members of IF Metall. These people are now thrown into unemployment during tough economic times, says Jonas Hagelqvist, CEO, IKEM.

The strike was implemented on 24 November 2023 and Hydro Extrusion has since lost important business relationships, suffered financial damage and is now forced to notify staff.

Sweden has a uniquely far-reaching right to industrial action, which means that even companies that have collective agreements and have no connection to the primary conflict can be exposed to disproportionate and unreasonable costs from conflicts.

- This undermines the duty of peace and thereby damages the collective agreement model, says Jonas Hagelqvist, CEO, IKEM.

- One of the Swedish industry's strengths is a low level of conflict and reliable rules of the game. It promotes both exports and investments in Swedish industry. The current situation tarnishes the image of Sweden. The risk is that companies choose to make investments and new establishments in countries other than Sweden going forward, says Jonas Hagelqvist, CEO, IKEM.

Hmm. An idea occurred to me. :)

It was mentioned earlier that 60% of Swedish companies with under 50 people do not have collective agreement. So apparently that is tolerated.

What if Tesla Sweden was split into multiple companies? Make each service center a separate company. So instead of Tesla Sweden you would have Tesla Stockholm, Tesla Malmö and so on.

Union can only start a strike if there are union member employees who request help from the union. Most if not all current strikers are in Umeå and Uppsala service centers, it's very likely other service centers are "union free"..

Good idea, but let the union show its cards. We'll do that if everything else fails ;)

The Swedish Transport Agency gives Tesla the right – can use the loophole

UPDATED TODAY 05:36PUBLISHED TODAY 03:24
Tesla may continue to use replacement plates to get around the blockade, the Swedish Transport Agency announces. The loophole was supposed to be reviewed, but the authority now announces that they are not proceeding with the investigation.
Since employees at Postnord stopped handing out license plates to Tesla cars as a sympathy measure towards IF Metall, the electric car manufacturer has found a loophole.
Tesla uses a method of changing ownership and the Swedish Transport Agency's service for replacement plates to get new cars out even during the conflict. The replacement plates are actually intended to replace damaged or stolen plates, but in this case it will be the cars' first.
Tesla can make these orders themselves, and doesn't have to ask the car owners themselves to order.
- That possibility exists from a service perspective, for example that a workshop should be able to assist the owner of a vehicle to order new registration plates via direct notification, writes the Swedish Transport Agency in an email to SVT.

"Never been used before"

The Swedish Transport Agency has previously said that the system has never been used in this way before.
The loophole became known in December , and the Swedish Transport Agency then announced that they would review the rules. Now they announce that they are not investigating the matter further.
- The authority will not currently proceed with an investigation regarding this service possibility, writes Susann Dahlberg Karlsson, section manager of the Vehicle Information Department at the Swedish Transport Agency, in an email to SVT.
It was in October last year that IF Metall started the strike against Tesla because the electric car manufacturer refused to sign a collective agreement in Sweden. On Thursday evening, the trade union commented on the announcement as follows:
- What is important now is that the state and authorities do not change rules during an ongoing conflict and if the regulations were like this before, it should continue to be like this. Then we thought it would be better if they (Tesla) couldn't do this, then we might have ended this conflict faster, says Veli-Pekka Säikkäle, contract secretary at IF Metall.

I wonder if the contract secretary at IF Metall has considered stand-up comedy as a fall-back career? That response was a fairly amusing string of malarkey. Granted, there was likely something lost in translation to explain how the logic came out so pretzel-like.

This is more like a non-flict than a conflict at this point, isn't it? 🤷‍♂️

Tesla is operating their business as usual, and the number of sympathizers who have lost their jobs exceeds the number of Tesla employees striking.

The agreement would have given Tesla the right to collect registration plates from the manufacturer SMC - The Swedish Transport Agency refuses and refers to scam reasons:

After Seko's notice against Postnord came into force on 20/11, deliveries of new license plates to Tesla's cars were also stopped, and thus car buyers' ability to pick up their cars. Tesla quickly got an okay from the manufacturer SMC to pick up the signs on site, but SMC's agreement with the Swedish Transport Agency required the authority's approval. But the Swedish Transport Agency refused, and Tesla therefore sued the authority.

On November 27, the Norrköping district court gave the Swedish Transport Agency seven days to let Tesla start collecting its signs directly from the manufacturer. The decision was appealed by the authority, but at the same time an additional agreement with the manufacturer was drawn up at a rapid pace, which opened up the possibility.

The agreement was completed on December 1, and the Swedish Transport Agency emailed SMC and asked them to sign two copies, scan and email, and post the originals. The agreement states that SMC sorts out Tesla's signs, and that a specially appointed person can pick them up at the manufacturer's premises every day between 1530-1600.

However, the supplementary agreement also stated that the agreement ceases to apply if a judgment or decision states that the Swedish Transport Agency no longer needs to disclose them. And so happened when the Göta Court of Appeal overturned the district court's interim decision and referred the matter back there.

The Swedish Transport Agency argues to the courts that it is unsafe to let someone pick up the signs from the manufacturer, as they could end up in the wrong hands. Nonsense, Tesla replies, and points out that until 2015 it was possible for anyone to collect their plates from SMC.

The Swedish Transport Agency's press manager Mikael Andersson today confirms the previous opportunity for the undersigned:

"I can confirm that there were instances where we made an exception to normal routine and allowed license plates to be collected directly from plate manufacturer SMC. However, this facility was removed from 4/11 2015."

- Routine exceptions?

"No, it would not be routine to make an exception. It required a contact with our managers in customer service who assessed each case individually whether an exception should be granted or not".

Routine or not, in any case there were _routines_ for something that the Swedish Transport Agency today claims is too unsafe. Yes, until 2015 owners were allowed to collect their plates from the manufacturer SMC if they asked, and decisions on individual cases were made at the _customer service level_.

On 12/1 this year, both Tesla and the Swedish Transport Agency submitted renewed submissions to the Norrköping district court. The authority argues:

"Tesla's desired order would mean that the authority loses the necessary supervision and control over the provision of license plates. It is not proportionate that the Swedish Transport Agency should be forced to concede safety aspects and lose supervision and control over the distribution of license plates".

The authority further points to how society would suffer if the signs fell into the wrong hands.

My comment:
This is clearly what an American would call "bullshit". Eight years ago, anyone at the Swedish Transport Agency's customer service could grant exceptions and let the car's owner pick up the plates themselves, on presentation of suitable identification. But now it is impossible to agree together with Tesla and SMC about which two people at Tesla would be allowed to do exactly the same thing? If the authority was in any way worried about signs ending up in the wrong hands, with false signage as a consequence, they would never have allowed PostNord to handle the shipments, which are, by the way, extremely easily identified in the mail aisle.

The reluctance to let Tesla pick up its own signs seems rather to have political reasons, alternatively a fear of being accused of undermining the union's blockade against Tesla. But an authority must first and foremost fulfill its mission, not protect the union's influence. Acting like now is just wrong.

Maybe I don't really understand. I see this as the equivalent of a state government in the USA - the authority that issues license plates and otherwise authorizes cars to be driven on the road. If they were to refuse to issue plates then new cars can't legally be driven. I'm assuming this is the same thing in Sweden.

Is vehicle registration a private company function in Sweden? Because if that's a government function, then it looks like the Swedish government is taking the position that Swedish consumers are not allowed to purchase Tesla vehicles. Well - they can BUY the cars, but they can't drive them :)

The Swedish government agency issues the registration and passes it off to a private company to make the plates, that private company then delivers the plates to PostNord, I think they are part private part governmental, to delivery them to the recipient. PostNord is subject to a sympathy action, as called for by IF Metall, so they just put all the mail to Tesla in a big pile and ignore it.

But the point is Tesla found a work-around and the Swedish government has decided that they aren't going to change the rules. So, Tesla can continue to get new vehicles on the road, by transferring the ownership of the vehicle to the new owner early and having a second copy of the plates sent to the new owner of the vehicle. (So it costs Tesla a little extra time and money, but probably not a big deal.)

I'm just speechless. I had multiple paragraphs written about just how unreal this is to me, and decided not to fill y'all's eyeballs with it.

Short version - my point of view - the Swedish government, at the behest of a private entity, is committing some pretty fundamental violations of the universal declaration of human rights. I'm sure I can make a case for many, but Article 7 is about the rule of law. The Swedish government taking an official stance, and even fighting in court, at the behest of and on the side of a private entity, against another private entity, pretty clearly makes Tesla a lesser entity not worthy of the same protection of the rule of law as anybody else in Swedish society.

Except that in many cases, its not Tesla - its Swedish citizens that choose to purchase a Tesla - that are no longer being afforded protection of the rule of law.

Saying that PostNord or the Transport Authority are actually private companies doesn't change this in any way. Unless they are fully private and are not engaged in fulfilling a government function.

I could well be wrong about this (I'm not a lawyer, much less licensed to practice law in Sweden) - I see these 2 entities as private contractors, on contract to the government and fulfilling a governmental function / obligation. As a result - there is zero difference.

Because if there IS a difference, then its not really a government function, and the Swedish government does not guarantee equal access to these private functions to all - its just whimsy who PostNord and the Transport Authority choose to provide their private service to and who they don't. Too bad they also have a monopoly on this service that most countries consider a government function.

The Union thinks it's bad to be a garbageman:

After the blockade – Tesla solves the garbage disposal
Since December 29, there has been a blockade against all waste management at Tesla's facilities in Sweden.
According to the union, the company has solved the problem by, among other things, renting a van.
The blockade against waste management at Tesla has been going on for almost a month. But outside the workshop in Segeltorp in Stockholm, there are no noticeable traces of it. A few stacks of pallets stand outside the facility and other debris can be seen in containers - but it is far from a towering mountain of garbage.
The explanation for this is that employees at Tesla now take care of parts of the waste on their own. This is claimed by the Transport trade union, which is behind the sympathy measure in support of IF Metall's strike.
- The blockade works at all Tesla workshops. No collection of waste has been made from our members. The signals we're getting are that this is very troublesome for Tesla. Our members say that Tesla's employees have had to take garbage home with them at the end of the working day, says Elin Lörnbo, press officer at Transport.
Carl Stern, ombudsman at IF Metall in Stockholm who follows the company's actions to get around the sympathy measures, says that Tesla personnel in Stockholm have also handled more bulky waste.
- They have rented a van and driven away waste which they dump at a recycling centre. It's everything except household rubbish and larger waste that they can't handle at all, he says.
Tesla does not want to answer questions from DN about how the company handles waste management since the blockade came into effect.
- You can wonder how the staff themselves feel about going from civil servant or car mechanic to garbageman[deregatory phrase more like garbage oldster in swedish]. They don't look very happy when they're doing it anyway, says Carl Stern.
Elin Lörnbo at Transport believes that the blockade will become more and more noticeable for Tesla as time goes on.
– The intervals for emptying different materials vary. Now the blockade against waste management has been going on for almost four weeks, but some materials may only be picked up once a quarter. As a whole, however, it is growing all the time, she says.
Fact. The strike against Tesla IF Metall triggered its strike on October 27 to achieve a collective agreement. It now applies to all service and repairs of Tesla cars - both at the company's own workshops and at others that service the cars. The union is also blocking work on an important crash protection component at the company Hydro Extrusions.
Subsequently, a number of trade unions have announced sympathy measures - everything from the Electricians and Painters to Seko and Real Estate Employees. The Transport Association is blocking all ports and since December 29 all waste handling at Tesla's facilities.
Since December 20, the handling of Tesla has been boycotted in all three neighboring countries.

Okay, so Tesla has solved another roadblock easily enough. If I were working at a Tesla Sweden location I would happily volunteer to help haul the trash at the end of the shift, just to stick it to those trying to thwart the best employer in the nation.

But, I might be biased, being a HODLer and all.
Ironically, if Tesla was part of a union it might have been illegal for regular employees to do waste management ;)

Work is work.

You have to admit, these union representatives absolutely don’t care how many feet they put in their mouths at once.
