Exactly. And now you can walk in to any Chevy dealer and buy a Volt for $33k. Prices always go down.
Obviously they should have lowered prices more slowly. Or not overpriced it so much to begin with.
What they should have done was wait until next year. Then drop the price and call it their 2019 model. That's what all other car manufacturers do. Then nobody would have right to complain. They didn't though and they screwed up bad. I'm willing to bet we could push a class action suit against them if we banded together. Then maybe nobody loses FUSC, PUP owners get 5k and NonPUP owners get PUP or cash option. Any lawyers in this forum?

Legally, they don't owe us a damn thing, and that suit would be laughed out of court, assuming you could find someone to even file it.

I'm still going to take my refund though, assuming they follow through.

Legally they committed false advertising by marketing a product as Performance and charging 11k for nothing more than a software unlock. They also misled customers repeatedly by failing to accurately describe the parts included in PUP. Both are illegal in the state of California.

That is hilariously nonsensical.

TONS of cars gain performance with software changes, and charge for them.

Heck there's entire businesses whose primary product is selling software changes to add performance to cars.

They also misled customers repeatedly by failing to accurately describe the parts included in PUP.

Which parts, specifically, did they not describe accurately?

Both are illegal in the state of California.

I'd love you to cite the specific laws you imagine they violated here :)
 
I was a day one pre-order. Waited in line for hours to be one of the first. Then waited for AWD after initial release. I was surprised and elated when they announced the Performance model. So I ordered that as soon as I got the email to configure.

Did any other day one pre-order folks buy the P3D?
Yep! I waited in line and ordered the P3D. Worth the wait!!

You're right there are. But nobody else charges $11k for it. It's more like $1k for any ECU mod.

Specifically they misled about the brakes. When I ordered mine the original PUP description was literally "performance red painted brakes". Which to me read as "we painted these brakes red to look like performance brakes." In no way is that description unambiguous in describing the improved functionality it has over stock. And they also failed to give any further description to clarify. When I asked my delivery specialist they had no idea what the difference was other than the paint.

You may think that's silly and nonsensical but that is blatant misrepresentation in my book.

I'm not gonna say you're smoking crack, but people that smoke crack are the only people that are going to agree with your claim.

If you think I'm wrong, contact a lawyer. Try not to take it too harshly when they laugh at you. If they don't laugh, and say they'll take your case, I'm sorry in advance for the extra money you're lightning on fire.

Despite what you may think I'm not stupid enough to waste money on a lawyer over this. If you read my original question correctly you would have realized I was asking if anyone on here was a lawyer and thought it was worthy of a case. Not that I am going to run out and waste thousands to stick it to Tesla. Tesla has already committed to giving us 5k or PUP anyway. That's enough to shut me up.

The issue was the lack of communication, not that they lied. They let people think what they wanted and got orders based on pure speculation, confidence and trust in the company. People now feel misled or taken advantage of, but legally they did nothing wrong.

So all we can do is votevote our wallets next time we buy a car. Fool me once....

My opinion of the company is also on lightswitch mode, either they make this right somehow or they dont. either way it's going to make a huge impact on future purchases for me.

Of course, this would be impossible to prove without direct evidence, but I am certain this is what took place. There is no way their QC would send cars out like that unless they had specific instructions to do so.

It's their R&D that allowed the "uncorking" possible.

Does the car not perform to the spec they disclosed and you willingly paid for.

If the brakes were that vague, why did you pay for it?

I didn't. I chose not to buy PUP because I didn't think it was a good value, especially since I don't want the 20" wheels. But if I had known about the brakes I would have just bought it anyway since it costs about 5k to get good aftermarket parts anyway. My issue now is that by including it at base only two months into production they've now killed the resale value for any non PUP version.
 
Those brakes outside of the track are functionality equivalent to the standard brakes. They also make smaller wheel and tire fitment considerably more difficult. I don't think the items in the pup are worth $5k.

Agreed. I ordered a P3D- for the same reason - just didn't see $5K worth of value in the upgrade package. Plus I drive my car daily so didn't want the increased road noise or greater susceptibility to curb rash. I'll happily trade my FUSC for $5K.

When I called the service department and the had the wrong name "Raul" I was like what? They said oh sorry that was the previous owner you bought it used right?

Another punch delivered by tesla.... I guess I got a used car for a new price, the odometer did say 12 miles though. Is there some way they could have reset this? I just figured they replaced my rejected car with someone elses reject car, not sure why it would say it had a previous owner in their computers then though?

It has paint chipped off the side of the door like something was slammed in it, and the door will not close properly either I hope they can fix it and it and it's not going to be like this forever. I often forget that it needs to be slammed to close and one of these days I will walk away with it unlocked I am sure!
