Correct but this contract is only for a place in line to order a car... It is a fully refundable deposit for a place in line to order a car, not a deposit for the purchase of the car. The terms will be in the purchase agreement something all other limited available cars have. Ford did it with the GT, Lexus did it with the LFA.

Money was exchanged to hold your place in line. Period. Read the pre order agreement as posted and point out where it requires you to purchase a car.

It is no longer refundable. It can be applied towards a purchase but it is forfeit if you don’t purchase one.

Requiring a person to purchase the vehicle isn’t part of the contract. Actually, it has a provision to cancel the purchase and receive the money back.

It does have a resellers clause that shouldn’t be allowed to change since it is a contract.

Point is moot anyway; the 1-year/$50k clause was retracted.

Yes, the resellers section covers the resale, attempting to put punitive damages on that beyond cancelling the sale is not a good look. If they think you are flipping it (immediately available for resale with under 100 miles) they will come after you.

Under the current agreement, which 1+ million people entered into, Tesla will "unilaterally cancel any order that we believe has been made with a view toward resale of the Vehicle or that has otherwise been made in bad faith." Not in the agreement, but Tesla has been known to do, is block future sales.

Where in the current agreement, again which 1+ million people entered into, are punitive damages stated or where is there an ‘under 100 mile’ clause?

There can, and there is rumored to be, a separate purchase agreement when you actually buy a vehicle. They can, and again rumor is they will, state things like a reseller clause there, legally.

Hopefully the rumor is wrong.

Your deposit is not a purchase agreement!!!! The Deposit is for a place in line to place an order for a car! Once you complete this and press the order button a purchase agreement is generate. This is how every manufacturer works when buying a car! This is the document you get in The finance office. Don’t confuse a purchase agreement that lists price and terms with a deposit to order a car!

This is not a rumor. The MVPA is different than the pre order agreement. Whether or not there is a separate CT MVPA is up for debate.

My “come after you” meant they will cancel the sale.
 
Most rumors are that there will be 1 pack size at launch.

Hah, if they even give us specs. Might just be a photo op. They are popping up in showrooms but that might just be bait to draw people in. Would be interesting to see if anyone is allowed to sit inside and see what the screen shows or if they are truly demonstration pieces that might not be fully functional.
