Mine was this way too until the 45 update. Have you applied it yet?
My problems STARTED after the .45 update. I didn't have any problems on the previous three updates

Today the spoiler rose when the car turned on and behaved normally today. Maybe it likes the rain.

FWIW, you can. In settings, there's an option for "Extended" or "Active."The first thing that came to my mind when I learned that some of the 90Ds were being delivered with active spoilers was "Can I keep it open at all times?".
The fixed version is starting to grow on me too. Not that I have a choice. Pretty sure mine will be fixed.I may be an outlier, but I am really glad my car came with a fixed spoiler.
