Everything else is wrong, while I'm not sure of the legality, this isn't very ethical from your standpoint.

You owe them the money for last month, you owe them the money for this month. Unless you went out and spend last months money (which you shouldn't have, because you knew sooner or later they'd come get it), why do they need to spread it over the next few months?

Two wrongs don't make a right.

Not disputing I owe them money, however I have a confirmation email from Tesla that indicates zero action is needed on my part and that all charges will be automatically debited As to legality they have agreed to the ACH and the schedule. My responsibility is payment. However, if they mis-process information and result in them not receiving or processing payment properly I am not liable for late fees or lump sum due if it takes them 3 months to determine they have an issue. As I lawyer I read every single line of their responsibilities and mine. In terms of spending last months money, I am very careful with my budgets but we are approaching a holiday season and I do not want to deal with that double amount. If you look at the list of things they have screwed up so far with this car and the process they can figure out a way to break the payments up as a courtesy if nothing else. Not my fault one of their Finance people confirmed they put it in the system and then never did. No way they are going to survive the Model 3 numbers if they don't get their act together.

YIKES! Is it too late to just return the car?? Or exchange it for something comparable? Man, this has been one tough journey for you.

Believe me I have considered it and thought about looking at my contract again.

Frankly, at this point I would look into what needs to be done for you to hand it back over.

They likely will try and fight tooth and nail to keep me in the lease.

It sounds like you had a long list of issues. Did the SC fix anything? Did they do the battery swap?

They supposedly did the battery swap, though according to the invoice they did everything else too. I refused to sign the paperwork as most was not completed.
 
Did you get a decent loaner? Over 2 weeks without the P90D is tough, and out of a 2 year lease.

Gotta agree with @Max* though. That lease money should just be burning a hole in your checking account so don't make it hard on the Tesla finance people, even though you're pretty upset with Tesla at the moment. It's only $640 anyway. Don't expect much sympathy here about the payment issue.:D

Sure hope you get all the defects fixed soon. Not a good sign for the Model 3.

When I read 'as a lawyer' why do I have no sympathy for OP's woes? And especially when he refuses to pay on time what is legitimately owed to Tesla !

If you read all of OP's posts vis-a-vis his entire delivery experience going back to October you will see why his level of frustration with Tesla is so high. I'm sure in normal circumstances he would just pay and be done with it.

Lucky you! 2014 S85 with AP, probably a pleasant surprise based on your VIN.

Well this isn't the first time Tesla Finance screwed up, this is about number 3 for them. I asked them politely to split it up as a courtesy. I was angry when I wrote the post. It more concerns me than anything.
 
So as many of you know I leased a P90D w/ Lud under the crazy 2 year fire sale. Well many of you know that I flew to Cleveland to get the car after all kinds of issues and still more existing. so another one popped up today and I wanted to let everyone see the current list and the new item(s).

Existing:
Car delivered with 482 more miles than it had when it was reserved
Upper hatch and lower hatch interior trim scuffed badly and covered with a permanent marker
Right passenger wheel scuffed badly
Left passenger wheel chipped
Driver's mirror cap rock chipped to an extremely excessive state

New:
Drivers pillar interior trim falling off
Battery pack was a loaner

The second new item is the one that just came to my attention. Apparently nobody in the delivery chain knew or decided to flag the fact that I would be getting contacted by Tesla to have my battery pack swapped out because the one on the car is loaner pack. I spoke to my delivery specialist and she had no idea. The service center call person was confused when I said what do you mean loaner pack I just bought this car. These are the types of issues that just continue to flabbergast me. The battery pack is such the heart of the car and yet nobody thought it should be flagged when the car was sold!

So I scheduled the appointment for next week as that is the only time they had available. I asked about the other parts and they have no idea those were even being requested or what the status is.

Don't get me wrong, I love the car but boy the service and experience is terrible! I know someone posted contact information for a high level exec in CA so if anyone has that handy please post it here again.
I've always heard it's hard to find good help. I wonder how much Tesla pays their employees. Sounds like the manager at the Cleveland SC needs to step up his/her game. I'm more surprised when things go smoothly. There's so much incompetence out there.

I agree. We are now dealing with Tampa as that is where we live.

Accidents happen and I am not saying everything always needs to be perfect. What I am saying is this has been the most horrible buying experience, yes I know lease but the treatment should be the same, I have ever had with a car and it is by far the most expensive one. Tesla cannot seem to get out of their own way.

I appreciate @Footer making the comment he did. I am paying for a car I have spent a grand total of one month with yet have paid for two.
 
Also, Tesla charged me 3x this month for payments. This month full, last month full, and last month half and this month full together.

I guess that is what happens when they try to accommodate your request to spread their mistake over time, is more mistakes... (Probably hard to make the automated system do something non-standard.) So the last/this month payment was the system, and the half of last + this month was a manual processed one. (And they didn't get the automated paused.)

Apparently the finance person said she put notes not to process my auto ACH but someone did. Now they are processing refunds lol. Complete mess.
 
Okay just waiting for my refund but wanted to post. Aurora is now back home with her sister and brother which you can see in the picture.

I do need to say even though it took over 3 weeks Mark at Tampa SC really took care of me. The car looks brand new. Not a single nick or scratch to be found and I'm going to try to keep her that way. Certainly some speed bumps but Mark made sure it was right in the end. I blame Cleveland for not having the car ready in time and I thank the team in Tampa for fixing her.
