Is my car gonna be considered a total loss

So I was at a red light and a drunk driver rear ended me going about 40-50 MPH. Will insurance deem this a total loss? The car is 6 months old with 10k miles

Such bad luck, sorry about that.
I think the impact speed was well below 60mph but nevertheless it has done some damage. Things that influence repair will be if the body has been significantly distorted by the impact as it looks to be an angular impact and what other major cost structural damage has been done.
If I were you I would be hoping for a total loss though!
 
I'm not lawyer but if you got rear ended by a drunk driver I would hire a lawyer and ensure you got every dime you could, such as a brand new Tesla to replace that one. If it were me I wouldn't settle for the standard insurance claim of "here's a rental car we will fix yours soon" type deal.

It looks like a taller vehicle it ie perhaps no battery damage; I agree with above, it looks fixable from those pics but also agree with looking into going after the drunk driver for compensation

I hope you had a good physical assessment done for you, a hit like that puts a lot of stress on the body even well protected in a Tesla.
 
Its going to be a write off. The insurance company won't want to be on the hook for any hidden damage to the drive train due to the impact on the wheel/suspension. Not to mention that they have to replace the inner panels and outer panels plus frame straighten time. Then you have sensors and electronics that need to be replaced/calibrated etc. Not worth the time and liability will be the calculation. Car will be worth more in parts than what they pay you.
