Same here. Got nerfed with the September 2019 software update and experienced three big step-downs in range from 256 to 244 to 232 to 226. Supercharging rates will hit as high as 128kW under ideal conditions, but tapers down to ~60kW a few minutes later. With the expansion of stalls and Supercharging locations, my remedy is to charge between 8%-68% SOC and drive to furthest uncrowded Supercharger I can. I also don't drive to destinations beyond 500 miles with our Tesla...anything further than 400 miles invokes my inner "Level 3 charging envy."I wasn't notified but I seriously think I was affected. Around the late summer/fall of 2019 my max range on my Model S dropped from 233 miles to 220. Now I get 215.
I was never contacted by Tesla nor the plaintiff attorney so I assume they either wanted a quick settlement or they did not get a complete list of affected owners. On the bright side of not participating in the class, you can pursue other class action or file your own suit in the future with this settlement as a precursor. Another assumption is that it might be challenging to get good representation because I don't think the recovery will be adequate for lawyers with the right balance of curiosity and expertise (especially since those who settled would be out of the class).
