Wrong. And if he consults an attorney() they will tell him so. VERY common for pain/injuries to not reveal themselves until sometimes many hours after an accident. He has video proof, was rear ended, he was totally NOT at fault in this severe accident.

He can get PAID.
Yeah I don't know what that would have to do with going to court, but it was already obvious at the time of accident that there was no immediate life threatening injuries. Other than that I don't know, but will be getting checked up in the next few days.

My insurance declared me not at fault very early, and I had consulted with some lawyers per a friend's recommendation. They were pretty quick to take my case. Just need to get results of appraisal and go from there.

And yeah I ordered a new vehicle just in case right after the accident.

Truth. I can attest to this. I got 7X what my medical/chiropractor expenses were on top of my car etc.

Did you sign for 33 and 1/3 to go to the lawyer? If NOT...take time and shop around. I took like, 2 weeks before I signed with a firm that would go with 20% fee. In the end, I ended up with thousands more in my pocket vs the law firm.

It was YOU that was injured..not the lawyer..

I just went through something similar and you definitely want to get an attorney involved.
I was stopped at a red light in my 911 when a guy in a lifted Ram 2500 decided he wanted to be in my lane ( his GPS was telling him to make a right turn in a few hundred feet) so he just changed lanes but he couldn't see me so he literally drove over the front of my car. 2003 911 with under 30k miles totaled on the spot. I was going 0 m.p.h when this happened and I was compensated nicely.
Talk to a lawyer, people need to be held reponsible for their actions.

if you look at the video closely, OP was moving slower than all the traffic around including the white car on the right lane, which was going about the same speed as others, except that black car that hit it.
If OP was going slower than everyone else around him/her, the white car was not illegally passing him on the right since OP was just too slower than others. I think the black car is the only one to blame (in my personal opinion) for speeding and illegal lane change.
You have no clue how fast traffic was moving in front of him. Man, some people just like to create issues.

Hey everyone, car (2022 Model Y Performance) got rear ended recently and this is how it looks. I know most people aren't insurance adjusters or anything, but would appreciate feedback from anyone who has experience with or has seen this level of damage. If anyone has idea of roughly how much this would cost to repair (or if it's bad enough to be a total loss), would be great.
Also, it's undriveable. Wheel gets caught every half rotation.
Thanks. I am sad.View attachment 830069
What a bummer! Makes me cringe to look at that photo. My wife's Model 3 got clipped a couple of weeks ago. I will be taking her Tesla to West Coast Specialists in San Diego. They do all kinds of exotics

did the white car escape totally unscathed?
They ended up having a slightly dented door and mild dent in front fender near the door. Paint was also scraped off a bit. I think relatively minor compared to me and the black car, since mine received the bulk of the impact.

@rickybobbee was your situation your party or the other at fault? does that make a difference in whether the insurance would consider a total?

FYI: All insurance companies use a math formula to declare total. Typically if repair costs come to somewhere around 80% to 90% of the actual market value of the car? Then its declared a total loss.

Despite what your ins guy said about "we dont total teslas". They total ALL brands.

Relax. I’m not trying anything here. Just provided my input based on the video. Also that’s why I used the word “IF”, since i didn’t know what was actually happening outside of the video frame.
You should stop instantly judging people without fully understanding the context. 😎

NO they do not. im not getting second hand information.....I am dealing with it myself right now. ICBC treats tesla different due to there price, parts, rarity etc....icbc is a canadian insurance in BC , which is a monopoly and do whatever the F they want. I know it sounds unbelievable and that's why there is a class action to basically roll back the old rules. It's against the law to hire a lawyer to fight the insurance company. ONE insurance company and government owned and run. google ICBC insurance.......it'll be a good read

it was the others fault. it's a tesla issue with ICBC which is the one and only insurance in BC canada. what is comes down to is they don't like tesla(not my words but theirs). They would rather give the money to the bodyshops and rental car etc... than give it to tesla. ICBC is not happy that tesla is going to be providing their own cheaper, better insurance......among other things. ICBC is a monopoly here and the government wants to keep it that way

Ah I see. I'm in the states, and it appears initial estimate is 15k worth of repairs. Although the adjuster said that's just from exterior, they expect a larger amount once it's been inspected with a teardown of that part.

Or fake injury claims.
I would be very careful about pursuing injury claims with an attorney. The OP did not mention any injury suffered from the accident and depending on the other drivers insurance company, they could be very aggressive fighting any “questionable “ injuries.
I would be most concerned with getting your car fixed or replaced for full value (without cost to OP) and getting the cost of a rental car covered for the long period of time it will take to fix/ reorder a Tesla.
Good luck.

I agree and was not suggesting OP was going down that path but a few folks were encouraging it. Obviously from the USA.

If car is repaired OP should push hard for lost value.
