Will Tesla try to recoup the $5k back from me? i guess thats my concern and plays into upgrading or not
Legally yes - go read the terms they are very clear on the website - the terms of the rebate state that:
1 - you must hold the car for 12 months
2 - if you sell the car before the 12 month period, the dealership or store is required to recuperate the rebate from you and pay it back to the government.
Please also realize that the private re-sale tax on the vehicle is higher than the tax you paid to purchase it new.
Will Tesla attempt to recoup the rebate from you and pay it back to the government? Likely not - however you have to take the risk of a future audit. When you transfer ownership of the the vehicle, there will be a legal record of the purchase date, rebates and transfer date. If the government really wanted to, they could easily do an audit. However I don't think that currently they have the incentive or manpower do perform such audits.
Having said that I see lots of people flipping re-bate cars on craigslist. I would not personally assume the risk, but your mileage may vary!
